The two annual programmes, and who owes them

  • Retail workplace violence prevention, from ten employees statewide. Labor Law section 27-e defines a retail employer as one “employing at least ten retail employees” – counted statewide rather than nationwide since Chapter 72 of 2025, signed 14 February 2025. The employer adopts the Department of Labor’s model retail workplace violence prevention policy or an equivalent and distributes it at hire and annually thereafter. Training is delivered at hire, then annually where there are 50 or more retail employees and every two years below 50 – the small-employer relaxation also introduced by Chapter 72. From 1 January 2027, employers of 500 or more retail employees statewide must provide every retail employee with a silent response button, which may be a fixed device, wearable or phone-based, with location tracking prohibited except when activated.
  • Harassment prevention, from one employee, every year. Labor Law section 201-g provides that training “shall be provided to all employees on an annual basis” and must be interactive, at every employer with no minimum headcount. The policy must meet or exceed the state model – last updated August 2024 – and both policy and training material must be given in writing in English and in each employee’s identified primary language, at time of hiring and at every annual training. Where the Commissioner publishes no template in a language, English suffices.
  • New York City layers its own on top at fifteen. Local Law 96 of 2018 requires annual interactive training at 15 or more employees – with independent contractors counting toward the 15 regardless of hours – for all employees including supervisory and managerial staff and interns, covering the internal complaint process, external procedures with contact information, retaliation, bystander intervention and the specific responsibilities of supervisory and managerial employees. New hires are trained after 90 days where they work more than 80 hours in a calendar year. Records including a signed acknowledgment are retained at least three years, the notice is posted in English and Spanish, and the factsheet goes to every new employee within the first week.
  • And you cannot recover the cost if the trained employee leaves. The Trapped at Work Act, Labor Law Article 37 sections 1050 to 1055, effective 19 December 2025, declares employment promissory notes “unconscionable, against public policy, and unenforceable”, expressly reaching training-cost repayment framing. Carve-outs cover genuine cash advances that are not training, property sold or leased to the employee, educational sabbatical terms and collectively bargained programmes.

The New York-Newark-Jersey City MSA employs 22,190 training and development specialists at a location quotient of 0.79 and an annual mean of $86,900 against a national mean of $75,550, while training and development managers sit at a location quotient of 1.20 with 3,520 employed at $186,140 against $148,370 (BLS Occupational Employment and Wage Statistics, May 2025 estimates, released 15 May 2026). More people designing programmes than delivering them, in a state that mandates delivery annually for every employer.
  • New York City’s own numbers. The city employs 12,530 training and development specialists at an annual mean of $90,450 and 1,910 training and development managers at $204,015, against all occupations at $95,518 (New York State Department of Labor occupational wages, May 2025 base updated to Q1 2026; NYSDOL states these estimates are not produced nor reviewed by the Bureau of Labor Statistics).
  • And the audience spans the whole wage range. Citywide private sector employment reached 4,219,200 in July 2026, up 64,000 over the year, with private education and health services adding 43,900. Average weekly wages by borough ran $3,422 in Manhattan down to $1,242 in Brooklyn, where health care and social assistance is 45.6 percent of private employment at an average annual pay of $46,456 (BLS Quarterly Census of Employment and Wages, Q4 2025 and 2025 annual averages). The same annual obligation covers a trading floor and a nursing home.
