The pay items a New York City payroll has to compute
- Schedule change premiums, priced by notice period. Under the city’s Fair Workweek Law, a covered fast food employer – part of a chain with 30 or more locations nationally – owes a premium for every employer-initiated schedule change: $10 per change on less than 14 days’ notice, $15 on less than seven days, and $15 to $75 on less than 24 hours, depending on whether hours increase, remain the same, or are reduced – reductions carrying the top $75 tier. A shift scheduled fewer than 11 hours after the previous one requires written consent and a $100 premium per clopening worked. Schedules run on 14 days’ advance notice, at least 336 hours before the first shift.
- Retail carries damages rather than a premium table. A covered retail employer – 20 or more employees aggregated across all New York City locations under common ownership or management, including part-time and temporary staff – must post schedules 72 hours in advance, both physically and individually to each employee, and may not cancel a shift on less than 72 hours’ notice or add more than 15 minutes without notice and written consent. On-call shifts are banned. Damages run to roughly $300 per worker for schedule-notice violations plus fines of $500 or more, and on-call violations at $500 or more per shift.
- Underneath that, the standard New York statement obligations. Labor Law section 195(3) requires the dates of work covered, employee name, employer name, address and telephone, rates and basis of pay, gross wages, deductions, allowances claimed and net wages – plus, for non-exempt employees, the regular hourly rate, the overtime rate, the regular hours worked and the overtime hours worked. Failures run at $250 for each work day to a $5,000 cap under section 198(1-d), with hiring notice failures at $50 per work day to a further $5,000 under section 198(1-b). Payroll records are preserved not less than six years under section 195(4). Premiums that never reach the statement are two violations, not one.
- And the rate structure has four figures. From 1 January 2026: $17.00 minimum wage in New York City, Nassau, Suffolk and Westchester and $16.00 in the remainder of the state; service employees $14.15 cash plus a $2.85 tip credit; food service workers $11.35 plus $5.65; and an executive and administrative exempt salary threshold of $1,275.00 per week, or $66,300 a year. New York sets no state threshold for the professional exemption. From 2027 the minimum wage is indexed to a three-year average of the Northeast Consumer Price Index and no dollar figure has been published.

Accommodation and food services employs 215,907 people in Manhattan alone at an average annual pay of $56,872, with Brooklyn adding 59,845 and retail a further 72,160 (BLS Quarterly Census of Employment and Wages, 2025 annual averages, private ownership). Citywide, private sector employment reached 4,219,200 in July 2026, up 64,000 over the year, with unemployment at 5.0 percent seasonally adjusted, down 0.4 percentage points.
- Payroll capacity is below national concentration. The New York-Newark-Jersey City MSA employs 7,770 payroll and timekeeping clerks at a location quotient of 0.83 and an annual mean of $66,110 against a national mean of $59,630 (BLS Occupational Employment and Wage Statistics, May 2025 estimates, released 15 May 2026). Fewer people to run a payroll with more moving parts than most.
