What the first days establish, legally
- A 30-day probation, and then just cause. Under the New York City Fair Workweek Law, a covered fast food employer – part of a chain with 30 or more locations nationally – may not, after a 30-day probation period, discharge an employee or reduce their hours by more than 15 percent without just cause supported by progressive discipline, or a bona fide economic reason. That has applied since 4 July 2021. It makes the onboarding period the only window in which a fit decision is straightforward, and it makes the progressive discipline record something that starts on day one rather than at the first problem.
- A good faith schedule estimate, before hiring. Covered employers must give a good faith estimate of future work schedules, and covered retail employers – 20 or more employees aggregated across all city locations under common ownership or management, including part-time and temporary staff – run 72-hour advance schedules, posted physically and transmitted individually, with on-call shifts banned outright. Fast food schedules run on 14 days’ notice, and shifts fewer than 11 hours apart need written consent and a $100 premium. The scheduling commitments made at hire are the ones the premiums are measured against.
- Four documents, one of them in two languages. Labor Law section 195(1) requires a hiring notice in writing in English and in the employee’s identified primary language, stating rates and basis of pay, allowances claimed, the regular payday and the employer’s name, trading name, address and telephone – with a signed and dated acknowledgment in both languages preserved six years, and $50 per work day to a $5,000 cap for failure. Labor Law section 201-g requires the harassment prevention policy and training material at time of hiring, in the same two languages, for every employer with no size minimum. Section 206-c requires the written lactation accommodation policy at hire. And in New York City, employers with 15 or more employees give the Commission factsheet within the first week.
- And leave exists before it accrues. Since 22 February 2026, under Local Law 145 of 2025, every New York City employee receives 32 hours of immediately-available unpaid protected time off on the first day of work, and again on the first day of each calendar year – not accrued, not waited for, not carried over. Paid sick leave under Labor Law section 196-b accrues from commencement at one hour per 30 hours worked, to 40 paid hours at five to 99 employees or 56 at 100 or more. Twenty hours of paid prenatal personal leave apply at every employer size. New hires in the city are trained under Local Law 96 after 90 days where they will work more than 80 hours in a calendar year.
