The determinations a co-employer cannot make for you
- Whether the scheduling law reaches you, and how the count works. A covered retail employer under the New York City Fair Workweek Law has 20 or more employees counted across all city locations under common ownership or management, including part-time and temporary workers, and is “engage[d] primarily in the sale of consumer goods” – meaning more than 50 percent of city sales transactions in the previous 12 months. A covered fast food establishment is part of a chain with 30 or more locations nationally. Those tests turn on your ownership structure and your sales mix, not on your payroll file. Retail damages run to roughly $300 per worker for schedule-notice violations plus fines of $500 or more, with on-call shifts banned outright at $500 or more per shift.
- The city’s decision-level rules, all at four employees. The Fair Chance Act covers applicants, employees, interns, freelancers and independent contractors, and requires a written analysis, copies of all background documents relied on and the job held open at least five business days. Local Law 32 of 2022 requires a good faith minimum and maximum in every advertisement including internal postings, with uncured or subsequent violations reaching $250,000 and no penalty for a first violation cured within 30 days. Local Law 144 of 2021 requires an independent bias audit of any automated hiring or promotion tool, published on your website, with 10 business days’ notice to candidates – and a PEO cannot be that independent auditor either.
- Records stay yours for six years. Labor Law section 195(4) requires payroll records “established, maintained and preserved for not less than six years”; the section 195(1) hiring notice acknowledgment – in English and the employee’s identified primary language – for the same six years; and New York City training records under Local Law 96 for at least three years with a signed acknowledgment. A demand can arrive long after a co-employment arrangement ends.
- And coverage obligations attach at one employee. Paid Family Leave requires most private employers with one or more employees to hold insurance, funded entirely by an employee contribution of 0.432 percent of gross wages in 2026 capped at $411.91. Labor Law section 201-g requires annual interactive training for every employer with no size minimum. And since 19 December 2025 the Trapped at Work Act has made employment promissory notes unenforceable, which invalidates the training-repayment and sign-on clawback language many standard offer templates still carry.

The New York City employer weighing this up
- Private sector employment reached 4,219,200 in July 2026, up 64,000 over the year, with unemployment at 5.0 percent seasonally adjusted, down 0.4 percentage points, and gains led by private education and health services at plus 43,900 (New York State Department of Labor).
- Wage bases differ by a factor of nearly three across the boroughs. Average weekly wages in the fourth quarter of 2025: Manhattan $3,422, Bronx $1,417, Queens $1,410, Staten Island $1,350, Brooklyn $1,242, against a United States average of $1,569 (BLS Quarterly Census of Employment and Wages, Q4 2025, released 2 June 2026). A per-employee-per-month fee is a very different proposition against a $46,456 care worker than a $454,761 banker.
- The in-house alternative. New York City employs 11,720 human resources managers at an annual mean of $213,376 and 30,000 human resources specialists at $103,613, against all occupations at $95,518 (New York State Department of Labor occupational wages, May 2025 base updated to Q1 2026; NYSDOL states these estimates are not produced nor reviewed by the Bureau of Labor Statistics).
