What a fractional function has to carry in New York City
- A longer protected list than anywhere else. The New York City Human Rights Law adds caregiver status, credit history, salary history inquiry, pre-employment marijuana testing, unemployment status, sexual and reproductive health decisions, height and weight, arrest or conviction record, partnership status, pregnancy and lactation accommodation, and status as a victim of domestic violence, stalking and sex offenses. It generally applies at four or more persons – but Administrative Code section 8-102 provides that for gender-based harassment the term employer “shall include any employer, including those with fewer than four persons in their employ.” Section 8-502 allows punitive damages, injunctive relief and fees to a prevailing party, and the law is construed liberally in favour of plaintiffs under the Local Civil Rights Restoration Act.
- The state layer has no size floor either. Executive Law section 292(5) covers “all employers within the state”, listing age, race, creed, colour, national origin, citizenship or immigration status, sexual orientation, gender identity or expression, military status, sex, disability, predisposing genetic characteristics, familial status, marital status and status as a victim of domestic violence. Section 296 disclaims “severe or pervasive”, leaving a defence only for conduct amounting to no more than petty slights or trivial inconveniences. Filing runs three years under section 297(5), with punitive damages and civil fines up to $50,000 – or $100,000 where the conduct is willful, wanton or malicious. Filing windows differ between the two forums: one year at the city Commission, three for gender-based harassment, three years in court, and no filing in both.
- Annual obligations that exist at one employee. Labor Law section 201-g requires an interactive annual training and a written policy for every employer, issued in English and each employee’s identified primary language, at hire and at every training. Paid Family Leave coverage attaches at one employee, employee-funded at 0.432 percent of gross wages in 2026 capped at $411.91. Section 206-c requires a written lactation accommodation policy at hire, annually and on return to work, with a response to requests within five business days. And 20 hours of paid prenatal personal leave apply with no size tier.
- And two things changed in December 2025 that a part-time function is most likely to miss. The Trapped at Work Act, effective 19 December 2025, makes employment promissory notes “unconscionable, against public policy, and unenforceable”, ending training-cost and sign-on repayment clauses. Chapter 681 of 2025 bans requesting or using consumer credit history in hiring, promotion and terms of employment, effective 120 days after signing. And the Reasonable Accommodation Anti-Retaliation Act amended Executive Law section 296 from 5 December 2025 for all employers.

- And of very different wage bases. Average weekly wages ran $3,422 in Manhattan, $1,417 in the Bronx, $1,410 in Queens, $1,350 in Staten Island and $1,242 in Brooklyn, against a United States average of $1,569. Citywide, private sector employment reached 4,219,200 in July 2026, up 64,000, with unemployment at 5.0 percent seasonally adjusted (New York State Department of Labor).
- A full-time HR leader costs $213,376. New York City employs 11,720 human resources managers at that annual mean and 30,000 human resources specialists at $103,613, against all occupations at $95,518 (New York State Department of Labor occupational wages, May 2025 base updated to Q1 2026; NYSDOL states these estimates are not produced nor reviewed by the Bureau of Labor Statistics). For an employer of thirty, that is a large fraction of payroll spent on someone who will be under-occupied.
