Where managerial discretion is limited by statute
- Just cause, and a 15 percent line. Under the New York City Fair Workweek Law, covered fast food employers – chains with 30 or more locations nationally – may not, after a 30-day probation period, discharge an employee or reduce hours by more than 15 percent without just cause supported by progressive discipline, or a bona fide economic reason. Effective 4 July 2021. Laid-off employees hold priority reinstatement for 12 months, by seniority, when the employer rehires or increases hours. Managers who rebalance a rota to solve a performance problem are, in that setting, making a disciplinary decision under another name.
- Scheduling changes cost money and require consent. Covered fast food employers owe $10 per change on less than 14 days’ notice, $15 on less than seven days, and $15 to $75 on less than 24 hours, with reductions at the top tier – plus $100 for each clopening worked where shifts fall fewer than 11 hours apart, which also needs written consent. Covered retail employers run 72-hour schedules, may not cancel inside that window, and may not use on-call shifts at all.
- The harassment standard is lower than the federal one, at any size. Executive Law section 296 disclaims “severe or pervasive” and leaves a defence only where conduct amounts to no more than petty slights or trivial inconveniences; section 292(5) covers “all employers within the state.” The state model policy required by Labor Law section 201-g must state that harassment is employee misconduct with sanctions against supervisors who knowingly allow it to continue. Complaints run three years under section 297(5), with punitive damages and civil fines up to $50,000 – or $100,000 where conduct is willful, wanton or malicious. The city law adds caregiver status, credit history, salary history inquiry, unemployment status, height and weight and more, and reaches any size for gender-based harassment.
- And accommodation retaliation became separately actionable in December 2025. The Reasonable Accommodation Anti-Retaliation Act, Chapter 600 of 2025, amended Executive Law section 296 effective 5 December 2025, for all employers. Alongside it, the New York City Fair Chance Act has reached current employees facing discipline since Local Law 4 of 2021 – so a decision informed by someone’s criminal history carries the same written analysis discipline whether they are a candidate or a ten-year employee.

A leader running sites in two boroughs is running two labour markets under one set of rules.
- If a problem escalates, the professional market is deep. The New York-Newark-Jersey City MSA employs 6,930 labor relations specialists at a location quotient of 1.75 – roughly 10.7 percent of the entire United States total – at an annual mean of $117,330, and 23,380 compliance officers at $104,670 (BLS Occupational Employment and Wage Statistics, May 2025 estimates, released 15 May 2026).
