How the penalties are structured, and why timing decides the cost
- Salary postings: a 30-day cure, then a quarter of a million. New York City’s Local Law 32 of 2022 imposes no civil penalty for a first violation cured within 30 days of notice – and penalties up to $250,000 for uncured or subsequent violations. The rule requires both a minimum and a maximum the employer in good faith believes it is willing to pay, at four or more employees, including on internal postings. State penalties under Labor Law section 218 run $1,000, $2,000 and $3,000 for first, second and subsequent violations, and Labor Law section 194-b adds the job description where one exists. Noticing a defective posting inside a month is worth a great deal more than noticing it in the second quarter.
- Automated hiring tools: no cure window, and daily accrual. Local Law 144 of 2021 sets penalties of “not more than $500 for a first violation and each additional violation occurring on the same day as the first violation, and not less than $500 nor more than $1,500 for each subsequent violation” – but “each day on which an automated employment decision tool is used in violation… shall give rise to a separate violation”, and each failure to notify is a separate violation again. The obligations are a bias audit within one year of use by an independent auditor, results published on your website, and 10 business days’ notice to candidates.
- Wage documentation: per work day, to a cap. Labor Law section 198(1-b) sets $50 for each work day a hiring notice violation continues, capped at $5,000 per employee; section 198(1-d) sets $250 per work day for wage statement failures, to a further $5,000. Payroll records run not less than six years under section 195(4). And the Fair Workweek Law’s enforcement gate is different again: a covered employer’s schedule-notice failures run to roughly $300 per worker plus fines of $500 or more, with on-call violations at $500 or more per shift.
- And some obligations simply recur. Labor Law section 201-g requires annual interactive training and an annual policy issue, in each employee’s identified primary language, for every employer. Local Law 96 adds annual training at 15 or more employees with three years of records. Section 206-c requires the lactation policy at hire, annually, and on return to work. Retail employers of ten or more statewide distribute a workplace violence policy annually under section 27-e. The Paid Family Leave rate resets each January – 0.432 percent capped at $411.91 for 2026 – and the 32 hours of city protected time off reset with the calendar year.
We are not attorneys and this is not legal advice. Enforcement matters, investigations and classification questions belong with New York employment counsel.
The employers this cadence is built for
- Private sector employment reached 4,219,200 in July 2026, up 64,000 over the year, with the seasonally adjusted unemployment rate at 5.0 percent, down 0.4 percentage points, led by private education and health services at plus 43,900 and professional and business services at plus 15,200 (New York State Department of Labor).
- Across five boroughs with very different economics. Average weekly wages in the fourth quarter of 2025: Manhattan $3,422, Bronx $1,417, Queens $1,410, Staten Island $1,350, Brooklyn $1,242, against a United States average of $1,569; unemployment in June 2026 ran from 4.6 percent in Staten Island to 7.1 percent in the Bronx (BLS Quarterly Census of Employment and Wages, Q4 2025, released 2 June 2026; New York State Department of Labor county data).
- Compliance capacity sits below national concentration. The New York-Newark-Jersey City MSA employs 23,380 compliance officers at a location quotient of 0.92 and an annual mean of $104,670 against a national mean of $88,400, and 52,370 human resources specialists at 0.94 and $98,100 (BLS Occupational Employment and Wage Statistics, May 2025 estimates, released 15 May 2026). More overlapping law than almost anywhere, and proportionally fewer people watching it.
How the subscription works for New York City employers
Exceptional HR Solutions has one physical location, in Melissa, Texas, and no New York office. A monthly engagement exists so the recurring items recur and the fixable things get fixed inside their windows – the postings reviewed before a complaint rather than after, the annual training delivered and recorded, the policies reissued in the right languages, the January figures updated before the first pay run. It is deliberately unglamorous. If what you need is a single fixed-scope project – one handbook, one audit, one investigation – a project fee is the honest structure and we will quote it that way instead.
