The leave entitlements, tier by tier

  • The four-or-fewer tier turns on net income. Under Labor Law section 196-b, an employer with four or fewer employees in a calendar year owes 40 hours unpaid where net income was $1 million or less in the prior tax year, and 40 hours paid where it exceeded that. From five to 99 employees the entitlement is 40 paid hours; at 100 or more it is 56 paid hours. In New York City the same tiers apply under the Earned Safe and Sick Time Act, with an additional row: domestic workers at an employer of four or fewer receive 40 paid hours regardless of the income test. A small, profitable firm can owe more than a larger, thinner one.
  • Plus 32 unpaid hours in the city, which do not carry over. Since 22 February 2026, under Local Law 145 of 2025, every New York City employee receives 32 hours of immediately-available unpaid protected time off on the first day of work and again on the first day of each calendar year – on top of the tier above. The accrued 40 or 56 paid hours carry over; the 32 reset. Covered reasons expanded to include care for a minor child or care recipient, attending legal proceedings on subsistence benefits or housing, responding to a public disaster and responding to workplace violence, and any union comparable-benefit carve-out must now cover the paid hours, the 32, the prenatal leave and no discipline for use.
  • Twenty hours of paid prenatal leave, with no tier at all. Labor Law section 196-b(4-a), effective 1 January 2025, requires “twenty hours of paid prenatal personal leave during any fifty-two week calendar period” in addition to sick leave, in hourly increments, at the greater of regular rate or applicable minimum wage, with no payout on separation. New York City requires it in addition to protected time off, under a rule effective 2 July 2025. Accrual generally runs at one hour per 30 hours worked, minimum increments may not exceed four hours, and balances must be produced within three business days of an oral or written request.
  • And Paid Family Leave costs the employer nothing but has to be carried. Coverage is required of most private employers with one or more employees and is fully funded by employee payroll contributions: 0.432 percent of gross wages per pay period in 2026 to an annual maximum of $411.91, funding 12 weeks at 67 percent of average weekly wage, capped at 67 percent of the state average weekly wage of $1,833.63 – a maximum weekly benefit of $1,228.53. The rate and cap reset each January.

  • The wage base varies almost threefold inside one city. Average weekly wages in the fourth quarter of 2025: Manhattan $3,422, Bronx $1,417, Queens $1,410, Staten Island $1,350, Brooklyn $1,242, against a United States average of $1,569 (BLS Quarterly Census of Employment and Wages, Q4 2025, released 2 June 2026). The leave entitlement is measured in hours, so the same 56 hours cost a Manhattan employer several times what they cost a Brooklyn one.
  • At the floor, the arithmetic is direct. At the 2026 New York City minimum wage of $17.00, 56 hours of sick leave plus 20 hours of paid prenatal leave is about $1,292 per employee per year, calculated from the published rate and hour figures, before administration and before the 32 unpaid hours are staffed around.
  • Benefits expertise is concentrated here.
