The sequence a New York City hire has to follow
- Existing employees first, where the scheduling law applies. Under the city’s Fair Workweek Law, covered fast food employers – chains with 30 or more locations nationally – must offer available shifts to current employees before hiring new workers. Covered retail employers – 20 or more employees aggregated across all city locations under common ownership or management, including part-time and temporary staff, where more than half of city sales transactions in the previous 12 months were of consumer goods – operate under 72-hour advance schedules with on-call shifts banned outright. Recruiting into a covered operation without evidencing the internal offer first is a defect at step one, before any candidate is contacted.
- Then the advertisement, which has to carry a number. New York City’s Local Law 32 of 2022 requires both a minimum and a maximum the employer “in good faith believe[s] at the time of the posting they are willing to pay”, at four or more employees, with open-ended ranges prohibited and internal postings covered. Labor Law section 194-b adds the job description where one exists, at the same threshold, and reaches roles performed outside New York that report to a supervisor, office or work site in New York. Uncured or subsequent city violations reach $250,000; a first violation cured within 30 days carries no civil penalty. State penalties are $1,000, $2,000 and $3,000.
- Then the fair chance sequence, at four employees. No criminal history inquiry of any kind before a conditional offer, and no “no felonies” or “clean record” language in advertisements. Arrests without conviction, sealed cases, adjournments in contemplation of dismissal, youthful offender adjudications and violations are permanently off-limits. After the offer: a written analysis against the Fair Chance Factors, copies of all background documents relied on, and the position held open at least five business days. Protections extend to interns, freelancers and independent contractors, and since Local Law 4 of 2021 to current employees facing discipline. The Clean Slate Act has automatically sealed eligible convictions statewide since 16 November 2024.
- And credit history came off the table in 2026. Chapter 681 of 2025, signed 19 December 2025 and effective 120 days later, bans requesting or using consumer credit history in hiring, promotion or terms of employment. Exemptions are specific: where law requires it; peace and law enforcement officers; roles requiring a background investigation with a high degree of public trust; bonded or security-clearance positions; non-clerical roles with access to trade secrets or national security information; positions with signatory financial authority over $10,000 or fiduciary responsibility; and roles able to modify digital security systems.

Health care and social assistance alone is 45.6 percent of all private employment in Brooklyn at a location quotient of 2.68 (BLS Quarterly Census of Employment and Wages, 2025 annual averages, private ownership).
- Recruiting capacity is below national concentration and above national pay. The New York-Newark-Jersey City MSA employs 52,370 human resources specialists at a location quotient of 0.94 and an annual mean of $98,100 against a national mean of $81,990 (BLS Occupational Employment and Wage Statistics, May 2025 estimates, released 15 May 2026). Every one of the thirteen HR occupations measured in this metro pays above national, by 9 to 46 percent.
