What governs hiring in San Francisco
- The Fair Chance Ordinance, amended effective 10 August 2026. San Francisco Police Code section 4909 and following applies at five or more employees and covers positions where the employee works or will work at least 8 hours a week in San Francisco – including temporary, seasonal, part-time, contract, contingent, commission, agency-supplied labour, and paid or unpaid vocational or educational training. No inquiry into arrest or conviction records is permitted until after a conditional offer.
- What is permanently off-limits, which is broader than state law. Arrests not leading to conviction, except unresolved arrests; participation in a diversion or deferred-judgment programme; dismissed, expunged or invalidated convictions; juvenile adjudications; infractions; convictions more than seven years old, unless the role supervises minors or dependent adults; and decriminalised conduct including non-commercial cannabis use and cultivation. The distinctive 2026 provision: an employer may not use out-of-state convictions or arrests for conduct that is lawful in California, relating to abortion-related healthcare, drag performances, gender-affirming care, or spontaneous abortion. That has no analogue anywhere else in this project.
- The process, with its own clocks. Job advertisements must state that qualified applicants with arrest and conviction records will be considered, and an FCO notice must be posted at every workplace – with an updated poster required from 10 August 2026. On adverse action: a pre-adverse-action notice identifying the items relied on; the applicant has 7 days to respond with evidence of inaccuracy, rehabilitation or mitigation; the employer must confirm receipt within 14 days; then a final notice. That is materially stricter than California’s Government Code section 12952, which shares the five-employee threshold but has no seven-year look-back, no advertisement language requirement, no posting requirement and no out-of-state-conduct carve-outs.
- Pay disclosure runs alongside it. Labor Code section 432.3(c)(1) requires the pay scale to an applicant on reasonable request at all employers, and section 432.3(c)(3) in any job posting at 15 or more employees – redefined by SB 642 effective 1 January 2026 as a good faith estimate of what the employer reasonably expects to pay upon hire. Section 432.3(a) and (b) bar relying on or seeking salary history. San Francisco’s own Parity in Pay Ordinance (Labor and Employment Code Article 61) covered similar ground, and the Office of Labor Standards Enforcement has published that new legislation would sunset the Salary History Ordinance on 1 January 2026. Whether that sunset took effect, and what survives, is not something we have been able to confirm – so we rely on Labor Code section 432.3, which applies regardless.
- And automated screening is evidence from 1 October 2025. California’s Civil Rights Council automated-decision system regulations cover resume screening, video-interview analysis, skill assessments and applicant targeting, make anti-bias testing relevant to claims and defences, and extend retention of selection criteria records to four years.
We are not attorneys. Whether a specific conviction falls inside the seven-year window or the out-of-state-conduct carve-out is a legal question for California counsel.
A deep recruiting market in a shrinking white-collar economy
- Human resources specialists (SOC 13-1071) – the category covering recruiters – number 16,420 in the San Francisco-Oakland-Fremont MSA at a location quotient of 1.18 and an annual mean of $113,530 against a national mean of $81,990, about 1.38 times national (BLS Occupational Employment and Wage Statistics, May 2025 estimates, released 15 May 2026). Capability is abundant and expensive.
- Candidate availability improved. Unemployment in the MSA was 4.2% in June 2026 against 4.6% a year earlier, on a labour force of 2,446,906 with 101,556 unemployed. Payroll employment reached 2,424,100 seasonally adjusted in July 2026, up 7,500 or 0.31% over the year. The two series lag differently and should be stated separately; there is also no October 2025 figure, because the data was not collected during the 2025 lapse in appropriations.
- But the roles being filled are not the ones the city is known for. Over the year to July 2026 leisure and hospitality grew 3.5% and private education and health services 3.0%, while professional and business services fell 1.1%, information 3.3%, financial activities 3.8% and manufacturing 4.0%. Every high-wage white-collar supersector in San Francisco contracted.
- The layoff record confirms it. Between 1 July and 19 August 2026 California’s Employment Development Department recorded 8 WARN notices affecting 456 employees in San Francisco County, including Chime Financial at 135, OnPoint Logistics closure at 96, the SF Pretrial Diversion Project closure at 82, Salesforce at 74, Uber Technologies at 41 across three notices, and Udemy at 28. Hiring into that market is a different exercise from hiring into it two years ago.
