The pay rules a San Francisco sales plan has to satisfy
- The Equal Pay Act changed on 1 January 2026, and the change is structural. SB 642 amended Labor Code section 1197.5 so the prohibition runs to employees of “another sex” rather than the opposite sex; a civil action must be commenced no later than three years after the last date the cause of action occurs; and relief is available for the entire period the violation exists, up to six years. A cause of action occurs when the decision or practice is adopted, when an individual becomes subject to it, or when an individual is affected by its application – so adopting a commission plan starts its own limitation clock, independent of any individual’s pay.
- The city ordinance, and an honest gap. San Francisco’s Parity in Pay Ordinance (Labor and Employment Code Article 61, passed 19 July 2017) barred considering or asking about an applicant’s current or past salary and barred disclosing a former employee’s salary history without authorisation. The Office of Labor Standards Enforcement has published that new legislation would sunset the Salary History Ordinance on 1 January 2026. We have not been able to confirm whether that sunset took effect or what survives it, so we do not state a position on the city rule. Labor Code section 432.3(a) and (b) apply regardless: an employer may not rely on salary history in deciding whether to offer employment or what to offer, and may not seek it orally or in writing, personally or through an agent. Salary expectations may be asked under section 432.3(j), and prior salary can never justify a disparity under section 432.3(k).
- Pay scale disclosure, with a new definition that matters for variable pay. Section 432.3(c)(1) requires the pay scale to an applicant on reasonable request at all employers; section 432.3(c)(3) requires it in any job posting at 15 or more employees. As amended by SB 642 effective 1 January 2026, “pay scale” means a good faith estimate of the range the employer reasonably expects to pay upon hire – which for a commission role means a defensible view of realistic on-target earnings rather than a nominal base band. Penalties run $100 to $10,000 per violation, with no penalty for a first subdivision (c) violation if all postings are updated, and job title and wage rate history must be kept for the duration of employment plus three years.
- And at 100 employees, the numbers get filed. Government Code section 12999 requires a pay data report by the second Wednesday of May each year, including median and mean hourly rate for each race, ethnicity and sex combination within each job category. SB 464 made the court’s civil penalty mandatory from 1 January 2026 – up to $100 per employee, $200 for a subsequent failure – and requires demographic data to be stored separately from personnel records. From 1 January 2027 the job categories expand from 10 to 23.

San Francisco County averaged $3,779 a week in the fourth quarter of 2025 – 2.41 times the national $1,569 – while professional, scientific and technical services paid $6,213 across 130,918 employees and Information $7,312 across 59,810, against accommodation and food services at 66,755 employees (BLS Quarterly Census of Employment and Wages, Q4 2025, released 2 June 2026).
- And the top end is concentrating rather than growing. Professional, scientific and technical services wages rose 21.1% over the year while its employment fell 1.7%. Over the same period professional and business services employment across the metro fell 1.1%, information 3.3% and financial activities 3.8%. Designing a variable plan against last year’s on-target earnings in that market will produce a number nobody can hit or a number everybody clears.
