  • The two floors step six months apart. California’s minimum wage is $16.90 from 1 January 2026 and $17.40 from 1 January 2027, indexed under Labor Code section 1182.12(c)(1) by the lesser of 3.5% and the CPI-W change, determined on or before 1 August each year. San Francisco’s is $19.61 from 1 July 2026, with a Government Supported Employee rate of $17.35, adjusted every 1 July. The exempt white-collar salary threshold follows the state figure at two times minimum for full-time work under Labor Code section 515(a) – $70,304 in 2026 and $72,384 in 2027 – and the computer software employee exemption sits at $58.85 an hour, $122,573.13 a year, from 1 January 2026.
  • Final pay is immediate, and late costs thirty days. Labor Code section 201(a) makes wages “due and payable immediately” on discharge including layoff. Section 202(a) gives 72 hours where an employee quits without notice, or payment at the time of quitting where 72 hours’ notice was given; where the employee requests mailing, the date of mailing is the date of payment. Section 203(a) continues the employee’s wages as a penalty for a willful failure, capped at 30 days.
  • Nine items on every wage statement. Labor Code section 226(a) requires gross wages, total hours worked, piece-rate units and rates where applicable, all deductions, net wages, the inclusive pay period dates, the employee name and only the last four digits of the social security number, the legal entity name and address, and all applicable hourly rates with corresponding hours at each rate – which in San Francisco means the city rate and any other applicable rate shown separately. Records kept three years; production within 21 calendar days of a request under section 226(c), with a $750 penalty under section 226(f). Private penalties under section 226(e)(1) are the greater of actual damages or $50 for the initial pay period and $100 per subsequent violation, capped at $4,000. Labor Commissioner citations under section 226.3 run to $250 per employee initially and $1,000 subsequently.
  • And PAGA now rewards auditing. For actions brought on or after 19 June 2024, the default penalty under Labor Code section 2699(f)(2)(A) is $100 per aggrieved employee per pay period, dropping to $25 for derivative wage-statement violations where the employee could promptly and easily determine the accurate information from the statement alone, and $50 for an isolated non-recurring event. Section 2699(g)(1) caps recovery at 15% where all reasonable steps were taken before notice and section 2699(h)(1) at 30% within 60 days after – with periodic payroll audits and action on the results named as one of those steps. Section 2699(o) halves the penalty where the pay period is weekly.
