The San Francisco threshold ladder, and the state one underneath it
- One employee. California FEHA harassment liability under Government Code section 12940(j)(4)(A). The San Francisco Minimum Wage Ordinance, at $19.61 from 1 July 2026, applying to all employees performing work in the city including part-time and temporary.
- Five employees. FEHA generally, under section 12926(d); CFRA under section 12945.2(b)(4)(A); bereavement leave under section 12945.7; reproductive loss leave under section 12945.6; harassment prevention training under section 12950.1 – two hours for supervisors, one for everyone else, every two years. And the San Francisco Fair Chance Ordinance (Police Code section 4909 and following), amended effective 10 August 2026, which bars conviction inquiries before a conditional offer, cuts off convictions more than seven years old, and prohibits using out-of-state convictions for conduct lawful in California relating to abortion-related healthcare, drag performances or gender-affirming care.
- Ten employees. The San Francisco Paid Sick Leave Ordinance balance cap rises from 40 hours to 72 hours. Accrual is one hour per 30 hours worked and there is no annual use cap, so the state’s 40-hour limit does not cut off accrued city leave.
- Twenty employees. The Health Care Security Ordinance – $4.11 an hour payable for employers of 100 or more and $2.74 for those with 20 to 99 in 2026, rising to $4.49 and $2.99 on 1 January 2027, with a 2026 exemption for managerial, supervisory and confidential employees earning more than $128,861. The Family Friendly Workplace Ordinance – a right to request flexible or predictable arrangements, with a written response due within 21 days. And, counted worldwide, the Paid Parental Leave Ordinance, capped at $2,522 a week in 2026.
- Forty locations worldwide and twenty San Francisco employees. The Formula Retail Employee Rights Ordinances: two weeks’ advance schedules, predictability pay of one to four hours for changes on less than seven days’ notice, two to four hours for on-call shifts not called in, extra hours offered to existing part-timers first, and 90-day retention on sale.
- One hundred worldwide. The Public Health Emergency Leave Ordinance – up to 80 hours, dormant since the City’s COVID emergency ended 28 February 2023, reviving automatically on the next declaration.
- And with no threshold at all: California paid sick leave under Labor Code section 246, and the written workplace violence prevention plan under Labor Code section 6401.9, operative since 1 July 2024.
We are not attorneys. Which of these applies at your headcount and worksite is a legal question for California counsel, and the answer changes as you grow.
The most expensive labour market in the country, and it is contracting at the top
- San Francisco County’s average weekly wage was $3,779 in the fourth quarter of 2025 – 2.41 times the national $1,569 and the third highest of the largest US counties, behind Santa Clara at $4,542 and San Mateo at $3,947 – across 71,585 establishments and 703,715 employees, with wages up 8.9% over the year on the news release basis (BLS Quarterly Census of Employment and Wages, Q4 2025, released 2 June 2026).
- Professional, scientific and technical services is the largest private sector at 130,918 employees paying $6,213 a week, with wages up 21.1% while employment fell 1.7% – compensation concentrating into fewer, more senior roles. Information paid $7,312 across 59,810.
- And every high-wage supersector shrank. Over the year to July 2026, leisure and hospitality grew 3.5% and private education and health services 3.0%, while professional and business services fell 1.1%, information 3.3%, financial activities 3.8% and manufacturing 4.0%. The metro’s 0.2% total growth is carried by hospitality, health and government.
- Which makes the hire-versus-buy arithmetic stark. An HR manager in this MSA costs an annual mean of $219,270 and a compensation and benefits manager $203,270 (BLS Occupational Employment and Wage Statistics, May 2025 estimates, released 15 May 2026). A 30-person San Francisco company has crossed the FEHA, CFRA, training, Fair Chance, sick leave and workplace violence thresholds, is inside the HCSO and the FFWO, and cannot fund either of those salaries.
How we work as your fractional HR leader in San Francisco
There is no San Francisco office and no California staff. Exceptional HR Solutions operates from one location, Melissa, Texas, and San Francisco engagements run remotely on a standing cadence. A fractional arrangement means a named senior practitioner with time on your calendar who owns the HR roadmap and carries the decisions. In this city the roadmap starts with a threshold register, because seven local thresholds and a state layer beneath them is not something a growing company tracks by instinct.
Frequently asked questions
How many local thresholds does San Francisco have?
Seven that matter: one employee for the minimum wage, five for the Fair Chance Ordinance, ten for the higher sick leave balance cap, twenty for the Health Care Security and Family Friendly Workplace Ordinances, twenty worldwide for paid parental leave, forty locations with twenty city employees for formula retail scheduling, and one hundred worldwide for public health emergency leave.
Which California obligations have no threshold at all?
Paid sick leave under Labor Code section 246 and the written workplace violence prevention plan under Labor Code section 6401.9, operative since 1 July 2024.
At what size does California discrimination law apply?
Five employees for FEHA generally under Government Code section 12926(d), but one or more for harassment under section 12940(j)(4)(A).
What is the Health Care Security Ordinance obligation?
$4.11 an hour payable for employers of 100 or more workers and $2.74 for those with 20 to 99 in 2026, rising to $4.49 and $2.99 on 1 January 2027, with a 2026 exemption for managerial, supervisory and confidential employees earning more than $128,861 a year.
Why not just hire an HR leader?
Cost against size. An HR manager in the San Francisco-Oakland-Fremont MSA costs an annual mean of $219,270 and a compensation and benefits manager $203,270, per BLS May 2025 estimates released 15 May 2026 – while a company crosses most of the local thresholds well before it can fund either.
Is the San Francisco economy growing?
Barely, and not where the pay is. Total nonfarm employment grew 0.2% over the year to July 2026, carried by leisure and hospitality at 3.5% and private education and health services at 3.0%, while professional and business services, information, financial activities and manufacturing all contracted.
Are you located in San Francisco?
No. Our only physical location is Melissa, Texas, and San Francisco fractional HR work is delivered remotely. We have no California office, staff or partner network.
