One rate, and California’s penalty structure behind it
- The state floor is the only floor. California’s minimum wage is $16.90 from 1 January 2026 and $17.40 from 1 January 2027, announced 13 August 2026 after the Department of Finance certified the increase on 31 July. It is indexed under Labor Code section 1182.12(c)(1) by the lesser of 3.5% and the CPI-W change, determined on or before 1 August each year and taking effect the following 1 January; where the CPI-W change is negative there is no increase and no decrease. No City of Irvine minimum wage reaches private employers – the 2025 ordinance covers City employees and contractors on City service contracts of $200,000 or more – and no Orange County rate was identified.
- Exempt thresholds move with it. Labor Code section 515(a) sets the white-collar exemption at two times the state minimum for full-time employment: $70,304 in 2026 and $72,384 in 2027. The computer software employee exemption under section 515.5 is $58.85 an hour, $10,214.44 a month, $122,573.13 a year from 1 January 2026.
- Final pay is immediate, and late costs thirty days of wages. Labor Code section 201(a) makes wages “due and payable immediately” on discharge including layoff. Section 202(a) gives 72 hours where an employee quits without notice, or payment at the time of quitting where 72 hours’ notice was given; where the employee requests mailing, the date of mailing is the date of payment. Section 203(a) continues the employee’s wages as a penalty for a willful failure, capped at 30 days.
- Nine items on every wage statement. Labor Code section 226(a): gross wages; total hours worked; piece-rate units and rates where applicable; all deductions; net wages; inclusive pay period dates; employee name with only the last four digits of the social security number; the legal entity name and address; and all applicable hourly rates with corresponding hours at each rate. Records kept three years; production within 21 calendar days under section 226(c) with a $750 penalty under section 226(f). Section 226(e)(1) gives the greater of actual damages or $50 initially and $100 per subsequent violation, capped at $4,000, plus costs and fees, where the failure is knowing and intentional – though section 226(e)(3) excludes an isolated and unintentional payroll error due to a clerical or inadvertent mistake, and lets the factfinder consider whether the employer had adopted and complied with fully compliant policies.
- And PAGA rewards auditing. For actions brought on or after 19 June 2024, section 2699(f)(2)(A) sets a default of $100 per aggrieved employee per pay period, $25 for derivative wage-statement violations the employee could promptly and easily resolve from the statement alone, and $50 for isolated non-recurring events not extending beyond the lesser of 30 consecutive days or four consecutive pay periods. Sections 2699(g)(1) and 2699(h)(1) cap recovery at 15% or 30% where all reasonable steps were taken before notice or within 60 days after – with periodic payroll audits and action on the results named among those steps. Section 2699(o) halves the penalty where the pay period is weekly.

Orange County averaged $1,693 a week in the fourth quarter of 2025 – 7.9% above the national $1,569 – across 162,246 establishments and 1,682,919 employees, with private-sector pay at $1,686.
