What a small California employer owes, in order of size
- From the first employee: paid sick leave. Labor Code section 246 has no size threshold. Accrual of not less than one hour per 30 hours worked, usable from the 90th day, an employer-imposed use cap of 40 hours or 5 days a year, mandatory carryover of accrued days, and an accrual cap the employer need not exceed of 80 hours or 10 days. A front-load alternative exists if the full five days or 40 hours is granted at the start of each year. No payout on separation, but unused leave is reinstated on rehire within a year, and the balance must appear on the wage statement or a separate writing on payday under section 246(i). Irvine and Orange County add no local sick leave ordinance – which is a genuine simplification against San Francisco and San Diego.
- At five employees, five obligations at once. CFRA (Government Code section 12945.2(b)(4)(A)) – up to 12 workweeks for employees with more than 12 months and 1,250 hours of service, with a family definition covering grandparent, grandchild, sibling, domestic partner and a designated person. - At fifty, the ACA – and it may not be your fifty. Applicable large employer status is 50 full-time employees including full-time equivalents on a prior-year look-back, so part-time hours aggregate. The IRS states that companies with a common owner, or otherwise related under section 414 of the Internal Revenue Code, are generally combined and treated as a single employer (irs.gov, page reviewed 8 August 2026). For ERISA purposes 26 U.S.C. 414(b) and (c) apply an 80% parent-subsidiary test and an 80%-plus-50% brother-sister test, and section 414(m) reaches an affiliated service group at as little as 10% of interests held by highly compensated employees – which catches owners running two related businesses.
- And at one hundred plan participants, Form 5500. Measured at the start of the plan year; defined contribution pension plans count participants with account balances at line 6g(1), other plans use line 5, and a small welfare plan is exempt if unfunded or fully insured and not subject to Form M-1 (29 C.F.R. 2520.104-20). Penalties run up to $2,739 per day under ERISA section 502(c)(2) and $250 per day up to $150,000 from the IRS.
