Three California rules that constrain how HR systems are built
- Automated-decision systems are now regulated as employment decisions. The Civil Rights Council’s employment regulations on automated-decision systems, filed with the Secretary of State on 27 June 2025 and effective 1 October 2025, define an automated-decision system as a computational process that makes or facilitates a decision regarding an employment benefit – expressly covering resume screening, video-interview analysis, skill assessments and applicant targeting. Two consequences bind system design: 2 CCR section 11013(c) extends record retention from two years to four for selection criteria, automated-decision system data and related records; and section 11008(b) redefines “agent” to include a person acting on the employer’s behalf to exercise a function traditionally exercised by the employer, including through an automated decision system. Your vendor’s screening logic is your liability. Evidence of anti-bias testing – its quality, efficacy, recency, scope, results and what you did about the results – is relevant to both claims and defences.
- Demographic data must be stored separately from personnel records. Government Code section 12999(a)(3), added by SB 464 effective 1 January 2026: demographic information gathered for pay data reporting “shall be collected and stored separately from employees’ personnel records.” The reporting duty itself starts at 100 employees, or 100 hired through labor contractors, with the report due the second Wednesday of May – and from 1 January 2027 the job categories expand from 10 to 23, first applying to the report due May 2027. A single all-in-one employee record cannot satisfy the separation requirement without rework.
- Wage statements have nine mandatory fields and a 21-day clock. Labor Code section 226(a) requires gross wages, total hours, piece-rate units and rates, all deductions, net wages, pay-period dates, employee name with only the last four digits of the SSN, the legal entity name and address, and every hourly rate in effect with the hours at each rate. Copies retained at least three years. Requests for inspection or copies must be met within 21 calendar days – miss it and section 226(f) imposes $750. Injury is deemed where an employee cannot “promptly and easily determine” the required information from the statement alone, so a compliant field list rendered badly still fails.
