Subscription-Based HR Services in Irvine CA

California’s 2024 PAGA reform pays employers who were already compliant. Take all reasonable steps before a notice arrives and penalties are capped at 15 percent; take them within 60 days after and the cap is 30 percent. The statute names the steps – periodic payroll audits, written policies, supervisor training – and they are all recurring work.

Why continuous compliance is now worth money in California

  • The penalty caps are the reform’s centerpiece. Under Labor Code section 2699(g)(1), if before receiving the section 2699.3 notice – or before a records request under sections 226, 432 or 1198.5 – the employer has taken “all reasonable steps to be in compliance” with the provisions identified, the civil penalty shall not be more than 15 percent of the penalty sought. Section 2699(h)(1) gives a 30 percent cap for taking those steps within 60 days after the notice. Sections 2699(g)(2) and (h)(2) define the steps non-exhaustively: periodic payroll audits and action on the results, disseminating lawful written policies, training supervisors on Labor Code and wage order compliance, and corrective action with supervisors. And critically, subdivision (g)(2) provides that a violation occurring despite those steps is not by itself enough to show the employer failed to take them. The 15 percent cap does not apply on the heightened section 2699(f)(2)(B) track.
  • The rest of the penalty structure rewards clean records. The default is $100 per aggrieved employee per pay period, section 2699(f)(2)(A). Derivative wage-statement violations drop to $25 where the employee could promptly and easily determine the accurate information from the statement alone – unavailable if no itemized statement was provided at all. An isolated, non-recurring event not extending beyond the lesser of 30 consecutive days or four consecutive pay periods is $50. The $200 rate applies only where an agency or court told you within the preceding five years that the policy was unlawful, or the conduct was malicious, fraudulent or oppressive. Weekly payrolls have penalties halved under section 2699(o). Standing narrowed too: an aggrieved employee must have personally suffered each violation alleged, section 2699(c)(1).
  • One notice is now due every February. SB 294, the Workplace Know Your Rights Act at Labor Code sections 1550 to 1558, requires a stand-alone written notice to every current employee on or before 1 February 2026 and annually thereafter, and to each new employee on hire. Content is fixed by section 1553(a): workers’ compensation rights and DWC contact details, the right to notice of an immigration-agency inspection under section 90.2(a), protection against unfair immigration-related practices, the right to organize, and constitutional rights when interacting with law enforcement at the workplace. Records of compliance, including the date each notice was sent, are kept three years, section 1553(e). Employers also had to give employees the chance to name an emergency contact by 30 March 2026, and must notify that contact if the employee is arrested or detained on the worksite, section 1555. Penalties run to $500 per employee per violation, and for section 1555 $500 per employee per day capped at $10,000 per employee.
  • Sick leave is a running calculation, not a one-off setup. Labor Code section 246 applies to all employers with no size threshold. Accrual is at least one hour per 30 hours worked, use begins on the 90th day, use may be capped at 40 hours or five days a year, accrual need not exceed 80 hours or 10 days, and accrued days carry over. Front-loading the full 40 hours or five days removes accrual and carryover. Alternative accrual must reach 24 hours by the 120th calendar day and 40 hours by the 200th. The available balance goes on the wage statement or a separate writing each payday. From 1 January 2026, section 246.5(a)(2)(C) adds attending judicial proceedings as a crime victim or family member to the permitted purposes.
  • No City of Irvine or Orange County ordinance binding private employers was identified. These are state obligations and they recur regardless of your local footprint.

We are not attorneys and none of this is legal advice. A live PAGA notice, a cure proposal or an early evaluation conference belongs with California employment counsel immediately.

What compliance capacity costs in this market

  • BLS publishes no occupational wage estimates for the Anaheim-Santa Ana-Irvine metropolitan division, so the figures below come from the Los Angeles-Long Beach-Anaheim MSA, the only OEWS area covering Irvine, and are labelled as such.
  • Compliance officers (SOC 13-1041) 17,700 at a location quotient of 1.05 and an annual mean of $98,740 against a national mean of $88,400, median $94,810 (BLS Occupational Employment and Wage Statistics, May 2025 estimates, released 15 May 2026). Human resources specialists number 36,850 at a location quotient of exactly 1.00 and $89,780 against $81,990.
  • The concentration tells you something useful. Neither occupation is concentrated here – both sit within five percent of national concentration, unlike San Francisco where labor relations specialists run at 2.02 and compensation and benefits managers at 1.67. Orange County is a market where compliance work is done by generalists carrying it alongside everything else, which is exactly the pattern the section 2699(g)(2) steps are hardest to sustain in.
  • Wages here are above national but not extreme. Orange County’s private-sector average weekly wage was $1,686 in Q4 2025 against a national private-sector average of $1,584, with an all-sector county average of $1,693 across 162,246 establishments and 1,682,919 employees (BLS Quarterly Census of Employment and Wages, Q4 2025, released 2 June 2026). Penalties computed per employee per pay period scale with headcount, not with wage level.

How the subscription works for Irvine employers

Exceptional HR Solutions has one physical location, in Melissa, Texas, and no Irvine office. A monthly engagement exists to make the recurring items actually recur: the February notice sent and evidenced, the payroll audit run on a schedule rather than after a complaint, supervisor training delivered and recorded, policies reissued when the law moves. That is deliberately unglamorous, and it is the work section 2699(g)(2) describes. If what you need is a single fixed-scope project – one handbook, one audit, one investigation – a project fee is the honest structure and we will quote it that way rather than convert it into a subscription.

Questions

Frequently asked questions

What are the PAGA penalty caps?

Fifteen percent of the penalty sought if all reasonable steps to comply were taken before the section 2699.3 notice, under Labor Code section 2699(g)(1); thirty percent if taken within 60 days after the notice, under section 2699(h)(1).

What counts as all reasonable steps?

Sections 2699(g)(2) and (h)(2) list periodic payroll audits with action on the results, disseminating lawful written policies, training supervisors on Labor Code and wage order compliance, and appropriate corrective action with supervisors. The list is non-exhaustive.

When is the Know Your Rights notice due?

On or before 1 February each year to every current employee, and on hire to each new employee, under Labor Code section 1553(a). Compliance records including send dates are kept three years.

How much California sick leave must we provide?

At least one hour per 30 hours worked, usable from the 90th day, with use capped at 40 hours or five days a year and accrual capped at 80 hours or 10 days. Front-loading the full five days or 40 hours removes accrual and carryover.

Does one violation still expose us to a whole-workforce claim?

Not as before. Section 2699(c)(1) now requires the plaintiff to have personally suffered each violation alleged, and section 2699(a) limits the representative group to employees against whom the same provision was violated.

What does compliance capacity cost around Irvine?

In the Los Angeles-Long Beach-Anaheim MSA, compliance officers average $98,740 with 17,700 employed at a location quotient of 1.05, and HR specialists $89,780 with 36,850 employed at 1.00.

Do you visit our Irvine office?

No. Everything is delivered remotely from our single location in Melissa, Texas. We have no California office and no travelling consultants.
