What governs hiring in Irvine

  • The California Fair Chance Act, at five employees, and nothing local on top. Government Code section 12952 bars any conviction-history question on an application before a conditional offer and any inquiry into or consideration of conviction history until after one. Arrests not followed by conviction, diversion participation, and sealed, dismissed, expunged or pardoned convictions may never be considered. Denial based on conviction history requires an individualised assessment weighing the nature and gravity of the offence, the time elapsed and the nature of the job; preliminary written notice with a copy of the report; at least five business days to respond, plus five more where accuracy is disputed; consideration of the response; and a final written notice. Implementing regulations at 2 C.C.R. section 11017.1 took effect 1 October 2023 and were amended by the 2025 automated-decision rulemaking. No City of Irvine or Orange County fair chance ordinance was identified – unlike unincorporated San Diego County, which adds a mandatory written assessment and penalties to $20,000, or San Francisco, which adds a seven-year look-back.
  • Pay disclosure, with the 2026 definition change. Labor Code section 432.3(c)(3) requires the pay scale in any job posting at 15 or more employees, and section 432.3(c)(1) on reasonable request to an applicant at all employers. As amended by SB 642 effective 1 January 2026, “pay scale” means a good faith estimate of the range the employer reasonably expects to pay upon hire. Penalties run $100 to $10,000 per violation, with no penalty for a first subdivision (c) violation if all postings are updated, and job title and wage rate history must be kept for the duration of employment plus three years, with failure creating a rebuttable presumption in the employee’s favour.
  • Salary history is off limits. Section 432.3(a) and (b) bar relying on or seeking salary history, orally or in writing, personally or through an agent; section 432.3(j) permits asking about salary expectations; section 432.3(k) provides that prior salary can never justify a pay disparity.
  • And one 2025 rule that reaches job advertisements directly. Government Code section 12940(q), added by SB 1100 effective 1 January 2025, makes it unlawful to state in a job advertisement, posting, application or other material that an applicant must have a driver’s licence unless the employer reasonably expects driving to be one of the job functions and reasonably believes that using an alternative form of transportation – including ride-hailing, taxi, carpooling, bicycling and walking – would not be comparable in travel time or cost. In a car-dependent county, that clause sits in more postings than most employers realise.

An unusually broad candidate market, for California

  • The layoff mix is not technology. Between 1 July and 19 August 2026, California’s Employment Development Department recorded 12 WARN notices affecting 896 employees in Orange County – Wind & Sea Restaurant closure at 198, Sodexo closure at 164, Sentinel Restaurant & Hospitality closure at 113, GMRI/Yard House closure at 78, Tencent America at 68, ELC Beauty/Too Faced closure at 67, Yamaha Motor Finance USA closure at 61, Obsidian at 52, Conduent at 51, DHL Supply Chain closure at 33 and Veritone at 10. Hospitality, food service and retail dominate. Over the same window San Francisco’s notices were overwhelmingly technology and finance, and San Diego’s were health care and manufacturing.
  • Availability improved slightly. Unemployment in the Anaheim-Santa Ana-Irvine metropolitan division – coterminous with Orange County – was 4.1% in June 2026 against 4.3% a year earlier, on a labour force of 1,596,053. Division nonfarm employment reached 1,694,800 seasonally adjusted in July 2026, up 0.42%. The two series lag differently, and there is no October 2025 figure because the data was not collected during the 2025 lapse in appropriations.
  • Where the hiring actually is. Private education and health services grew 4.9% over the year to July 2026 to 293,500 and leisure and hospitality 3.0% to 245,300, while information fell 5.3% to 21,600 and government 5.2% to 143,700. In the county, health care and social assistance is the only large private sector growing, at 244,208 employees and up 5.4% (BLS Quarterly Census of Employment and Wages, Q4 2025, released 2 June 2026).
  • Recruiting capability sits at exactly national concentration. BLS publishes no occupational estimates for the Anaheim-Santa Ana-Irvine division, so the figure comes from the Los Angeles-Long Beach-Anaheim MSA: 36,850 human resources specialists at a location quotient of 1.00 and an annual mean of $89,780 against a national $81,990, about 1.10 times national (BLS Occupational Employment and Wage Statistics, May 2025 estimates, released 15 May 2026).
