What an Irvine assessment finds, and what it does not

  • The local layer is essentially empty, and that is the finding. No City of Irvine ordinance binds private employers generally. Irvine adopted a minimum wage ordinance in 2025 adding Division 6, “Minimum Wage Requirements,” to Title 2 of the Irvine Municipal Code – but its scope is narrow: a full-time City Minimum Wage Requirement of state minimum plus $8.50 and a part-time rate of state minimum plus $3.50 for City employees, and a Contractor Minimum Wage Requirement of state minimum plus $3.50 for employees of Contractors, defined as parties entering a service contract with the City with an estimated value of $200,000 or more in any consecutive 12-month period, including subcontractors. Bids and contracts already in process at the effective date are excluded, as are bona fide volunteers. We do not publish the final ordinance number, adoption date or current rate: the version available is an unnumbered draft with a blank adoption date, and there are unverified reports of a later Council vote adjusting the rate. Confirm with the City before relying on any figure.
  • And the County of Orange adds nothing. No county labour ordinance binding private employers was identified – no county minimum wage, paid sick leave, fair chance ordinance, fair workweek ordinance or office of labor standards. That is a search that returned nothing rather than an affirmative confirmation from the County, and we phrase it that way. No city in Orange County was found to have a general private-employer minimum wage ordinance either.
  • Which puts the entire burden on state law – and it starts at one. FEHA applies at five or more persons under Government Code section 12926(d), but at one or more for harassment under section 12940(j)(4)(A). Paid sick leave under Labor Code section 246 and the written workplace violence prevention plan under Labor Code section 6401.9, operative since 1 July 2024, have no size threshold at all. At five: CFRA (section 12945.2(b)(4)(A)), Pregnancy Disability Leave (section 12945(a)(1)), bereavement leave (section 12945.7), reproductive loss leave (section 12945.6), harassment prevention training (section 12950.1) and the Fair Chance Act (section 12952). At 15: the pay scale posting duty under Labor Code section 432.3(c)(3). At 100: pay data reporting under Government Code section 12999, whose job categories expand from 10 to 23 on 1 January 2027.
  • And Cal-WARN bites before federal WARN does. Labor Code section 1400.5(a) triggers at a 75-person covered establishment – no company-size test – with a mass layoff defined at section 1400.5(d) as 50 or more employees in any 30-day period and no percentage test, plus a 100-mile relocation trigger federal law does not have. SB 617 added mandatory notice content effective 1 January 2026, so any template last revised before then is non-compliant.
