  • New York: a hiring notice, in two languages, kept six years. Labor Law section 195(1) requires a written notice at time of hire, in English and in the employee’s identified primary language, stating rates of pay and basis, any allowances claimed as part of the minimum wage, the regular payday, and the employer’s name, any d/b/a, physical address and telephone. The employer must obtain a signed and dated acknowledgment of receipt in both languages and preserve it for six years. Section 195(4) separately requires payroll records preserved not less than six years. Penalties under section 198(1-b) run to $50 per work day for notice failures, capped at $5,000.
  • California: a new standalone annual notice from 2026. SB 294, the Workplace Know Your Rights Act, added Labor Code sections 1550 to 1558. Section 1553(a) requires a stand-alone written notice to each current employee on or before 1 February 2026 and annually thereafter, and to each new employee upon hire, covering workers’ compensation rights, the right to notice of an immigration-agency inspection under Labor Code section 90.2(a), protection against unfair immigration-related practices, the right to organise, and constitutional rights when interacting with law enforcement at the workplace. Records of compliance must be kept three years including the date each notice was sent. Section 1555 requires employers to give employees the opportunity to designate an emergency contact no later than 30 March 2026, and at hire thereafter. Penalties under section 1558(d) run to $500 per employee per violation, and for a section 1555 failure up to $500 per employee per day capped at $10,000 per employee.
  • California also owes a pay scale on request, at any size. Labor Code section 432.3(c)(1) and (c)(2) require the pay scale to be provided to an applicant on reasonable request and to a current employee for their own position on request, at all employers – the 15-employee threshold applies only to including it in a posting. Section 432.3(c)(4) requires job title and wage rate history to be retained for the duration of employment plus three years.
  • Texas and Austin: essentially nothing to add. Texas Labor Code section 1.005, added by HB 2127 effective 1 September 2023, voids local ordinances regulating hiring practices and other terms of employment beyond state or federal law. The one open question is Austin’s Fair Chance Hiring ordinance, City Code Chapter 4-15, which the City still describes as enforced while section 1.005(b) names hiring practices as preempted; no court has ruled, and we recommend an onboarding sequence that would satisfy it either way.
