  • No local layer, by statute. Texas Labor Code section 1.005, added by HB 2127 (the Texas Regulatory Consistency Act) effective 1 September 2023, makes void and unenforceable any local ordinance regulating conduct in a field occupied by the Labor Code, expressly including employment benefits and employment leave. Austin’s 2018 paid sick leave ordinance had already been enjoined before its effective date and held unconstitutional in Texas Association of Business v. City of Austin, 565 S.W.3d 425 (Tex. App.-Austin 2018), with the Supreme Court of Texas denying review on 5 June 2020. There is no Austin benefit mandate and no route to one.
  • Related companies are counted as one employer. The IRS states that companies with a common owner, or otherwise related under the rules of section 414 of the Internal Revenue Code, are generally combined and treated as a single employer for determining applicable large employer status (irs.gov, page reviewed 8 August 2026). The ACA threshold is 50 full-time employees including full-time equivalents, determined on a prior-year look-back, so part-time hours aggregate and the determining data was created before anyone was watching.
  • COBRA is also a prior-year test. It applies at 20 or more employees in the previous calendar year, with continuation premiums chargeable at up to 102% of plan cost. Employers routinely cross it during a growth year and pick up the obligation the following January.
  • And the plan has its own reporting. A plan with fewer than 100 participants at the start of the plan year is a small plan for Form 5500 purposes; welfare plans count line 5 and defined contribution pension plans count participants with account balances at line 6g(1). A small welfare plan is exempt if unfunded or fully insured and not subject to Form M-1 (29 C.F.R. 2520.104-20). Filing is due the last day of the seventh month after plan year end, extendable by two and a half months on Form 5558, with penalties of up to $2,739 per day under ERISA section 502(c)(2) and $250 per day up to $150,000 from the IRS.
  • If you employ outside Texas, add their rules. Twenty-one jurisdictions require paid sick leave, most from the first employee in the state (Congressional Research Service Report R48921, 28 April 2026), and 23 states plus the District of Columbia have enacted paid family and medical leave programmes, 14 plus DC as mandatory payroll-funded social insurance (Bipartisan Policy Center, 23 April 2026 – a policy organisation rather than a government source).
