The payroll rules that follow your employees, not your office

  • New York pays manual workers weekly – and the damages changed in 2025. New York Labor Law section 191(1)(a) requires that “a manual worker shall be paid weekly and not later than seven calendar days after the end of the week in which the wages are earned.” The 2025 State Budget amended Labor Law section 198 (revision date 16 May 2025) to cap damages for a first frequency-of-pay violation at “no more than one hundred percent of the lost interest”, calculated at the daily rate prescribed by the Superintendent of Financial Services – but only where the employer paid wages on a regular payday no less frequently than semi-monthly. Repeat violators face full liquidated damages of 100% of wages due. That single amendment reset the economics of a whole class of New York litigation, and an Austin startup with New York staff on a biweekly cycle is exactly who it is about. Note that the courts are split on whether section 191 carries a private right of action – the First Department found one in 2019 and the Second Department held there is none in January 2024 – and we do not state that the question is settled.
  • California’s final pay is immediate, and late costs 30 days of wages. California Labor Code section 201(a) makes wages of a discharged employee “due and payable immediately.” Section 202(a) gives 72 hours for an employee who quits without notice, or payment at the time of quitting where 72 hours’ notice was given. Section 203(a) provides that where the failure is willful, the employee’s wages “continue as a penalty… at the same rate until paid,” capped at 30 days.
  • California wage statements carry their own penalties. Labor Code section 226(a) lists nine required items including all applicable hourly rates and corresponding hours; section 226(e)(1) gives an employee suffering injury from a knowing and intentional failure the greater of actual damages or $50 for the initial pay period and $100 per subsequent pay period, capped at $4,000, plus fees and costs. Records must be kept at least three years.
  • New York requires a wage notice and a detailed statement. Labor Law section 195(1) requires a written hiring notice in English and the employee’s primary language with a signed acknowledgment retained six years; section 195(3) requires a wage statement with each payment including, for non-exempt employees, the regular and overtime rates and the regular and overtime hours worked; section 195(4) requires payroll records preserved not less than six years. Penalties under section 198 run to $50 per work day for notice failures and $250 per work day for statement failures, each capped at $5,000.
  • Locally, nothing. Texas Labor Code section 1.005, added by HB 2127 effective 1 September 2023, voids local ordinances regulating employment leave, hiring practices, breaks, employment benefits and scheduling practices, so there is no Austin payroll rule to configure for.

It is the only one of the thirteen HR occupations BLS publishes for Austin that pays above the national figure (BLS Occupational Employment and Wage Statistics, May 2025 estimates, released 15 May 2026).
  • Few of them, priced slightly up. A location quotient of 0.75 means Austin carries about a quarter fewer payroll clerks per job than the country does, which is consistent with a metro that has automated or outsourced the transactional layer. HR assistants sit similarly low at 0.68.
  • The wider pattern is the opposite. Austin pays 6.9% above national across all occupations – $74,580 against $69,770 – while ten of thirteen HR occupations pay below national. Labor relations specialists are 22.0% below and compliance officers 12.6% below. Austin is a high-wage metro that discounts HR work specifically.
  • And the county you are in changes the arithmetic entirely. Travis County’s average weekly wage was $2,061 in the fourth quarter of 2025, against Williamson at $1,590 and Hays at $1,134 – a 1.8-times spread inside one metropolitan area, with the national figure at $1,569 (BLS Quarterly Census of Employment and Wages, Q4 2025, released 2 June 2026).
