What governs an executive hire in Austin

  • The unresolved one, stated honestly. Austin City Code Chapter 4-15, the Fair Chance Hiring ordinance (Ordinance No. 20160324-019, effective 4 April 2016), restricts criminal history inquiries by private employers with 15 or more employees in Austin. The City’s own Office of Civil Rights page still describes active enforcement, with no notice of preemption or suspension. But Texas Labor Code section 1.005(b), added by HB 2127 effective 1 September 2023, expressly names “hiring practices” as a field occupied by the Labor Code, and no obvious express authorisation exists for this ordinance. No court has ruled on the conflict. We will not tell you it is dead and we will not tell you it is enforceable – the defensible course is a process that would satisfy it either way, which costs very little.
  • The one that clearly does apply. Austin City Code Title 5, Chapter 5-3 prohibits discrimination in employment and rests on Texas Labor Code section 21.151, which expressly authorises local ordinances prohibiting practices already unlawful under state or federal law.
  • Federal thresholds govern the process itself. Title VII (42 U.S.C. 2000e(b)) and the ADA (42 U.S.C. 12111(5)(A)) at 15 employees for 20 or more calendar weeks; the ADEA (29 U.S.C. 630(b)) at 20, protecting those aged 40 and over.
  • And a posting is governed where the candidate sits. Texas requires no pay disclosure and restricts no salary history question. But 16 states plus the District of Columbia have pay transparency laws in force of 17 plus DC enacted – California, Colorado, Connecticut, DC, Hawaii, Illinois, Maryland, Massachusetts, Minnesota, Nevada, New Jersey, New York, Rhode Island, Vermont and Washington, with Virginia from 1 July 2026, Maine from 28 July 2026 and Delaware from 26 September 2027. New York’s Labor Law section 194-b applies at four or more employees and expressly covers a role performed outside New York that “reports to a supervisor, office, or other work site in New York.” California’s Labor Code section 432.3(c)(3) requires the pay scale in any posting at 15 or more employees, and as amended by SB 642 effective 1 January 2026 that scale is now defined as a “good faith estimate” of what the employer reasonably expects to pay upon hire. More than 20 states and localities restrict salary history inquiries, Virginia most recently from 1 July 2026.

  • Amazon announced a robotics manufacturing facility in Austin on 19 August 2026, described as a multi-billion-dollar development creating 300 to 500 manufacturing and engineering jobs. Apollo Global Management announced a new Austin strategic hub on 3 August 2026 (no job number disclosed). Southwest Airlines announced a pilot and flight attendant crew base at Austin-Bergstrom on 12 December 2025 – around 2,000 jobs by mid-2027 at a stated average salary of $180,000, supported by a $14 million Texas Enterprise Fund grant. All three are recorded in Office of the Texas Governor announcements, which are government records of company statements. Otsuka ICU Medical announced a $500 million-plus IV solutions manufacturing expansion in Austin on 9 July 2026 (jobs not stated), and Integrated Financial Settlements and Arcadia Settlements Group announced a headquarters relocation from Denver to Austin on 2 February 2026.
  • But candidate availability has improved. Austin metro unemployment was 4.1% in June 2026 against 3.5% a year earlier, on a labour force of 1,569,334 with 64,034 unemployed. Over that year the labour force grew by 12,950 while employment grew by only 2,886 – the increase is concentrated in the unemployed count (BLS Local Area Unemployment Statistics, June 2026 preliminary, file dated 21 August 2026).
  • Note the two series are a month apart. Austin payroll employment runs through July 2026 at 1,421,700 not seasonally adjusted, up 1.7% over the year; unemployment runs through June 2026. They should not be blended. There is also no October 2025 Austin unemployment rate – the data was not collected due to the 2025 lapse in appropriations, so any 2025 annual average is an eleven-month figure.
  • Executive supply is genuinely thin. Chief executives number 950 across the metro at a location quotient of 0.56, barely half national concentration, at an annual mean of $338,600 – 25.6% above national. General and operations managers number 42,190 at a location quotient of 1.45 and $146,480 (BLS Occupational Employment and Wage Statistics, May 2025 estimates, released 15 May 2026).
