What an assessment has to test against here
- Retail workplace violence obligations, at ten employees statewide. Labor Law section 27-e defines a retail employer as one “employing at least ten retail employees”, counted statewide since Chapter 72 of 2025, signed 14 February 2025. The employer adopts the Department of Labor model policy or an equivalent and distributes it at hire and annually, with training at hire and then annually at 50 or more retail employees or every two years below 50. From 1 January 2027, employers of 500 or more retail employees statewide must provide every retail employee with a silent response button, with location tracking prohibited except when activated. With retail at 69,904 in Nassau and 73,395 in Suffolk, this is not a niche finding.
- Annual harassment training and the policy behind it, at any size. Labor Law section 201-g requires interactive annual training for every employer with no minimum headcount, and a written policy meeting or exceeding the state model – last updated August 2024 – containing examples of prohibited conduct, remedies, a standard complaint form, a timely and confidential investigation procedure, an anti-retaliation statement and sanctions against supervisors who knowingly allow harassment. Policy and material go out in English and each employee’s identified primary language, at hire and at every annual training. Where an assessment finds a policy that exists but has never been reissued in the right language, that is a finding.
- Two county codes with no headcount floor. Suffolk’s Human Rights Law at Chapter 528 adopts the state’s definition of employer and, since Local Law 26-2020 on 23 June 2020, covers gender identity and protective hairstyles; it also carries a salary history ban and a ban-the-box provision at 15 or more employees with a private right of action. Nassau’s Title C-2 covers gender, race, color, creed, national origin, disability, age, religion, source of income and sexual orientation, with penalties of $5,000 to $10,000 to the aggrieved person plus a fine of the same range – and an election of remedies at section 21-9.9(a) removing Commission jurisdiction where the complainant has already filed in court or with the State Division.
- And several things a national assessment template will wrongly flag. There is no predictive scheduling law on Long Island – New York State has no equivalent to the New York City Fair Workweek Law. There is no automated hiring tool audit obligation – Local Law 144 is municipal and the state has no analog. There is no 32 hours of unpaid protected time off, no Local Law 96 poster or factsheet, and no separate Long Island minimum wage: Nassau and Suffolk sit in the same $17.00 region as New York City, with the same $1,275.00 per week exempt salary threshold.

- Suffolk is industrial. 690,153 private employees at an average annual pay of $81,103 – 103.0 percent of the national figure – with manufacturing at 50,061 and $89,113, the only New York area county where manufacturing is top-four and roughly three times Brooklyn’s; construction at 46,897 across 7,399 establishments at a location quotient of 1.28, the region’s highest; wholesale trade at 33,692 at 1.26; health care up 9.4 percent to 111,168; and finance and insurance at 21,048 paying $222,857.
- Nassau is balanced. 636,327 private employees at $79,792 – 101.4 percent of national – with health care at 150,369 and $82,190, a location quotient of 1.60 and growth of 5.7 percent; retail at 69,904; accommodation and food services at 52,145; professional and technical services at 39,043; other services at a location quotient of 1.49; and finance and insurance at 24,652 paying $152,360. No sector exceeds 1.60 – the most balanced mix in the region, at 10.0 employees per establishment.
- They pay identically and move differently. Both counties recorded an average weekly wage of exactly $1,634 in the fourth quarter of 2025 – 104.1 percent of the United States average of $1,569 – but employment rose 0.3 percent in Nassau and fell 0.1 percent in Suffolk over the year. Unemployment ran 3.5 percent in Nassau and 3.6 percent in Suffolk in June 2026, up from 3.2 percent in each (BLS Quarterly Census of Employment and Wages, Q4 2025, released 2 June 2026; New York State Department of Labor county data).
