What exists at one employee here

  • Both county codes reach every employer. Suffolk’s Human Rights Law at County Code Chapter 528, section 528-7, adopts the Executive Law section 292 definition of employer – so no headcount minimum – and was amended on 23 June 2020 by Local Law 26-2020 to add gender identity and protective hairstyles. Nassau’s Title C-2, section 21-9.8 covers gender, race, color, creed, national origin, disability, age, religion, source of income and sexual orientation, also with no headcount threshold, and carries penalties of $5,000 to $10,000 payable to the aggrieved person plus a fine of $5,000 to $10,000 for a first offense under section 21-9.9.1. Above both sits Executive Law section 292(5), covering “all employers within the state.”
  • Annual training, at every size, in the employee’s own language. Labor Law section 201-g requires interactive training annually and a written policy meeting or exceeding the state model – last updated August 2024 – with the policy and training material given in writing in English and in each employee’s identified primary language, at time of hiring and at every annual training. Required contents include examples of prohibited conduct, remedies, a standard complaint form, a timely and confidential investigation procedure, an anti-retaliation statement, and sanctions against supervisors who knowingly allow harassment.
  • Leave and coverage from the first hire. Paid Family Leave covers most private employers with one or more employees, employee-funded at 0.432 percent of gross wages in 2026 capped at $411.91, for 12 weeks at 67 percent of average weekly wage up to $1,228.53. Twenty hours of paid prenatal personal leave apply with no size tier. Sick leave under Labor Law section 196-b runs 40 unpaid hours at four or fewer employees below $1 million in prior-year net income, 40 paid above it or from five employees, and 56 at 100 – with balances produced within three business days of an oral or written request. Labor Law section 206-c requires 30 minutes of paid break time per lactation need for up to three years after childbirth.
  • And the paperwork duties are the same at ten people as at ten thousand. The section 195(1) hiring notice in English and the employee’s primary language, with a signed acknowledgment preserved six years; wage statements carrying the full section 195(3) list plus four extra items for non-exempt employees; payroll records kept not less than six years under section 195(4). And since 19 December 2025 the Trapped at Work Act has made employment promissory notes unenforceable, so training-cost repayment clauses in a small employer’s offer letter are dead letters.

We are not attorneys and this is not legal advice. Investigations, accommodation disputes and terminations belong with New York employment counsel.

The Long Island employer this is built for

  • Ten employees per establishment. Nassau counts 55,624 private establishments for 557,602 private jobs – an average of 10.0, against Manhattan’s 17.5 – and its private sector employs 636,327 at an average annual pay of $79,792, 101.4 percent of the national figure, with no sector above a location quotient of 1.60. Suffolk employs 690,153 at $81,103, with manufacturing at 50,061, construction at 46,897 and health care up 9.4 percent to 111,168.
  • Both counties pay $1,634 a week – 104.1 percent of the United States average of $1,569, the only identical pair in the New York region – across 56,359 establishments and 650,565 covered jobs in Nassau and 56,286 and 696,321 in Suffolk, with employment up 0.3 percent in Nassau and down 0.1 percent in Suffolk over the year (BLS Quarterly Census of Employment and Wages, Q4 2025, released 2 June 2026).
  • The full-time alternative costs almost city money. Long Island employs 1,430 human resources managers at an annual mean of $201,836 – 94.6 percent of the New York City figure of $213,376 – against all occupations at $81,447, or 85.3 percent of the city’s $95,518 (New York State Department of Labor occupational wages, May 2025 base updated to Q1 2026; NYSDOL states these estimates are not produced nor reviewed by the Bureau of Labor Statistics). For a ten-person employer that is not a realistic hire.

How fractional leadership works for Long Island employers

Exceptional HR Solutions has one physical location, in Melissa, Texas, and no Long Island office. Fractional means a defined number of hours a month against a defined scope, delivered remotely – not a person who appears when something goes wrong. If you need someone reachable within the hour and physically present, particularly across a manufacturing or construction workforce, this will frustrate you and we would rather say so before you sign. Where it works well is an owner or finance lead currently carrying HR alongside their real job, in two counties that regulate them as though they had a department.

Questions

Frequently asked questions

Do the county human rights laws have a size threshold?

No. Suffolk’s Chapter 528 adopts the Executive Law section 292 definition of employer, and Nassau’s Title C-2 provisions have no headcount threshold either.

What can Nassau County award?

Under section 21-9.9.1, $5,000 to $10,000 payable to the aggrieved person plus a fine of $5,000 to $10,000 for a first offense, and $10,000 to $20,000 for a subsequent one.

Do we need harassment training with three employees?

Yes. Labor Law section 201-g requires an annual interactive training and a written policy for every employer regardless of size, in each employee’s identified primary language.

How much sick leave does a small Long Island employer owe?

Forty unpaid hours at four or fewer employees with net income of $1 million or less in the prior tax year, 40 paid hours above that or from five employees, and 56 at 100 or more.

What does Paid Family Leave cost us?

Nothing in premium. It is funded by an employee contribution of 0.432 percent of gross wages in 2026, capped at $411.91 a year.

How long must records be kept?

Not less than six years for payroll records under Labor Law section 195(4), and six years for the signed hiring notice acknowledgment.

Will you be on site?

No. All work is delivered remotely from our single location in Melissa, Texas. If you need an on-site HR presence, we are not the right provider.
