What governs a Long Island hire

  • Suffolk: no conviction question until after the first interview. Suffolk County’s ban-the-box provisions at County Code Chapter 528, Article III, introduced by Local Law 14-2020, apply to employers with 15 or more employees and prohibit any conviction question on a preliminary application. The inquiry may come only after the application has been submitted and after a first interview. Enforcement runs through both a private right of action and a complaint to the county Human Rights Commission. Suffolk also bans salary history under section 528-7A(13), introduced by Local Law 25-2018, the “RISE Act”, effective not before 30 June 2019.
  • Nassau: no equivalent ordinance located. We identified no Nassau County salary history ban and no Nassau ban-the-box provision. That is the result of a search returning nothing rather than an affirmative confirmation from the county, so treat it as “none identified” rather than “none exists” and verify before relying on it. What Nassau does have is Title C-2, section 21-9.8, prohibiting discrimination on gender, race, colour, creed, national origin, disability, age, religion, source of income and sexual orientation, with no headcount threshold.
  • Statewide: pay transparency at four employees, and a description too. Labor Law section 194-b, effective 17 September 2023, applies to “any person, corporation, limited liability company, association, labor organization or entity employing four or more employees” and requires the compensation or range of compensation and the job description, if such description exists. Its reach includes roles “physically performed outside of New York but report[ing] to a supervisor, office, or other work site in New York.” Commission-only roles may be described by “a general statement that compensation shall be based on commission.” Employment agencies and recruiters are covered irrespective of size; temporary help firms are excluded. Penalties under Labor Law section 218 are $1,000, $2,000 and $3,000 for first, second and subsequent violations.
  • And New York City’s rules stop at the city line. The New York City Fair Chance Act – with its written analysis, five-business-day hold and four-employee threshold – does not apply on Long Island. Neither does Local Law 32‘s minimum-and-maximum requirement, nor Local Law 144‘s automated hiring tool bias audit, for which New York State has no equivalent at all. Long Island employers instead work from Correction Law Article 23-A and Executive Law section 296(15) and (16), plus the Clean Slate Act, which has automatically sealed eligible convictions statewide since 16 November 2024, and the statewide consumer credit history ban signed 19 December 2025.

The Long Island hiring market

  • The tightest labour market in the New York region. Unemployment in June 2026 was 3.5 percent in Nassau and 3.6 percent in Suffolk, against 3.2 percent in each a year earlier – compared with 4.7 percent in Manhattan and Queens, 5.3 percent in Brooklyn and 7.1 percent in the Bronx (New York State Department of Labor county data, not seasonally adjusted). Across the Nassau-Suffolk metropolitan division, private sector employment reached 1,206,100 in July 2026, up 7,500 or 0.6 percent over the year.
  • Two very different demand profiles. Nassau’s private sector employs 636,327 at an average annual pay of $79,792, led by health care at 150,369 and a location quotient of 1.60, up 5.7 percent over the year, with no sector above that concentration – the most balanced mix in the region. Suffolk employs 690,153 at $81,103, with health care up 9.4 percent to 111,168, manufacturing at 50,061 – the only New York area county where manufacturing is top-four – and construction at 46,897 across 7,399 establishments, the region’s highest construction concentration at a location quotient of 1.28.
  • Recruiting pay runs close to city levels. Long Island employs 5,670 human resources specialists at an annual mean of $95,93492.6 percent of the New York City figure of $103,613 – against all occupations at $81,447, or 85.3 percent of the city’s $95,518 (New York State Department of Labor occupational wages, May 2025 base updated to Q1 2026; NYSDOL states these estimates are not produced nor reviewed by the Bureau of Labor Statistics).
