What a Long Island payroll has to get right
- Manual workers are paid weekly. Labor Law section 191(1)(a): “A manual worker shall be paid weekly and not later than seven calendar days after the end of the week in which the wages are earned.” Large employers meeting Department of Labor criteria may apply for authorisation to pay semi-monthly; non-profits may negotiate a schedule no less frequent than semi-monthly. The 16 May 2025 amendment to section 198(1-a) caps a first frequency-of-pay violation at up to 100 percent of the lost interest on the delayed wages, calculated daily at the rate prescribed under Banking Law section 14-a – but only where the employer paid “on a regular payday, no less frequently than semi-monthly.” Repeat violators face full liquidated damages of 100 percent of wages due. Whether section 191 carries a private right of action is unsettled between the First and Second Departments; treat it as open. In a region with this much manufacturing, construction and wholesale work, the classification question is not academic.
- The same rate floors as New York City. From 1 January 2026: $17.00 minimum wage for New York City, Nassau, Suffolk and Westchester – there is no separate Long Island rate – with $16.00 in the remainder of the state. Service employees $14.15 cash plus a $2.85 tip credit; food service workers $11.35 plus $5.65. The executive and administrative exempt salary threshold is $1,275.00 per week, or $66,300 a year. From 2027 the minimum wage becomes indexed to a three-year average of the Northeast Consumer Price Index; no dollar figure has been published.
- County contracts carry their own rates. Suffolk County’s living wage at Chapter 575 binds contractors only – employers with 10 or more employees holding service contracts over $10,000 – at $17.86 an hour with health benefits or $18.02 without, plus 12 compensated days off. Nassau’s Title 57, binding contractors and lessees only, is $17.86 from 1 August 2026 with a $2.61 health supplement where no benefits are provided, totalling $20.47. Neither touches a private employer without a county contract, and both need a separate rate table if you hold one.
- And the documentation rules are statewide and unforgiving. Labor Law section 195(3) fixes the wage statement contents, adding for non-exempt employees the regular hourly rate, the overtime rate, the regular hours worked and the overtime hours worked – failures at $250 per work day to a $5,000 cap under section 198(1-d). The section 195(1) hiring notice must be in English and the employee’s identified primary language with a signed acknowledgment preserved six years, at $50 per work day to a further $5,000 under section 198(1-b). Payroll records run not less than six years under section 195(4).

- Suffolk is the industrial county. Manufacturing employs 50,061 people at an average annual pay of $89,113 – the only New York area county where manufacturing is a top-four sector, at roughly three times Brooklyn’s – with construction at 46,897 across 7,399 establishments and a location quotient of 1.28, the region’s highest, and wholesale trade at 33,692 and a location quotient of 1.26. Suffolk’s private sector employs 690,153 at an average annual pay of $81,103.
- Nassau is the balanced one. Its private sector employs 636,327 at $79,792, led by health care at 150,369 and a location quotient of 1.60, up 5.7 percent over the year – with no sector above that concentration. Nassau counts 55,624 private establishments for 557,602 private jobs, an average of 10.0 employees per establishment against Manhattan’s 17.5. Both counties recorded an average weekly wage of exactly $1,634 in the fourth quarter of 2025, 104.1 percent of the United States average of $1,569 (BLS Quarterly Census of Employment and Wages, Q4 2025, released 2 June 2026).
- Payroll staff cost almost what they cost in the city. Long Island employs 1,010 payroll and timekeeping clerks at an annual mean of $68,137 – 98.7 percent of the New York City figure of $69,057 – and 1,060 human resources assistants at $59,162, or 99.6 percent (New York State Department of Labor occupational wages, May 2025 base updated to Q1 2026; NYSDOL states these estimates are not produced nor reviewed by the Bureau of Labor Statistics).
