The rules a Long Island pay structure works within
- The same wage region as New York City – which surprises people. From 1 January 2026 the minimum wage is $17.00 for New York City, Nassau, Suffolk and Westchester, and $16.00 for the remainder of the state. Tipped rates are identical too: service employees at $14.15 cash plus a $2.85 tip credit, food service workers at $11.35 plus $5.65. The executive and administrative exempt salary threshold is $1,275.00 per week – $66,300 a year – the same as in the city, against $1,199.10 upstate. New York sets no state salary threshold for the professional exemption. There is no separate Long Island minimum wage, and any structure built on the assumption that there is will be wrong.
- Pay transparency at four employees, without the city’s extras. Labor Law section 194-b, effective 17 September 2023, applies at four or more employees and requires the compensation or range of compensation plus the job description, if such description exists. “Range of compensation” means “the minimum and maximum annual salary or hourly range… that the employer in good faith believes to be accurate at the time of the posting.” Commission-only roles may use “a general statement that compensation shall be based on commission.” Penalties under Labor Law section 218 are $1,000, $2,000 and $3,000 for first, second and subsequent violations. New York City’s Local Law 32 – and its $250,000 ceiling – does not reach Long Island.
- Suffolk bans salary history; Nassau’s position is unconfirmed. Suffolk County Code section 528-7A(13), introduced by Local Law 25-2018, the “RISE Act”, effective not before 30 June 2019, prohibits salary history inquiries. We identified no equivalent Nassau ordinance – a search returning nothing rather than a confirmation from the county, so verify before relying on it. Separately, Chapter 681 of 2025 banned the use of consumer credit history in hiring, promotion and terms of employment statewide, signed 19 December 2025 and effective 120 days later.
- And public contract rates are a separate schedule again. Suffolk County’s living wage provisions at Chapter 575 bind contractors only – employers with 10 or more employees holding service contracts over $10,000 – at $17.86 an hour with health benefits or $18.02 without for 2026, plus 12 compensated days off. Nassau’s Title 57 living wage, binding contractors and lessees only, is $17.86 an hour from 1 August 2026 with a $2.61 health supplement where no benefits are provided, giving $20.47. Neither applies to private employers without a county contract.

What the benchmarks actually show
- Nassau and Suffolk pay identically at the county level. Both recorded an average weekly wage of $1,634 in the fourth quarter of 2025 – 104.1 percent of the United States average of $1,569 – across 56,359 establishments and 650,565 covered jobs in Nassau and 56,286 and 696,321 in Suffolk, the only identical pair in the New York region (BLS Quarterly Census of Employment and Wages, Q4 2025, released 2 June 2026). Annual private-sector pay differs slightly: Nassau $79,792, Suffolk $81,103.
- Against New York City, the gap widens as you go up. Long Island averages $81,447 across all occupations against the city’s $95,518 – about 85.3 percent. But the ratio compresses to near parity in transactional roles: compensation and benefits specialists at 99.7 percent ($97,892 against $98,144), human resources assistants at 99.6 percent, labor relations specialists at 99.0 percent and payroll clerks at 98.7 percent. It widens sharply at the top: general and operations managers at 84.2 percent ($165,277 against $196,258) and chief executives at 81.8 percent ($340,201 against $415,907) (New York State Department of Labor occupational wages, May 2025 base updated to Q1 2026; NYSDOL states these estimates are not produced nor reviewed by the Bureau of Labor Statistics).
- That is the practical finding for a Long Island structure. You can hire administrative and specialist staff at essentially city rates, and you cannot hire senior people at anything close to a city discount without accepting a real gap. Long Island’s HR headcount runs roughly a sixth to an eighth of New York City’s across the same occupations, so the internal comparator set is small.
