What Long Island employers owe on training
- Annual, interactive, at every size, in the employee’s own language. Labor Law section 201-g provides that training “shall be provided to all employees on an annual basis” and must be interactive, for every employer with no minimum headcount – state guidance is explicit that this includes a household employing one nanny or housekeeper. The written policy must meet or exceed the state model, last updated August 2024, and both policy and training material must be provided in English and in each employee’s identified primary language, at time of hiring and at every annual training. Where the Commissioner publishes no template in a language, English suffices, and an employer is not penalised for errors in a Commissioner-supplied translation. New York City’s Local Law 96 content, poster, factsheet and three-year records do not apply here – section 201-g is the whole obligation.
- Retail employers of ten owe a second annual programme. Labor Law section 27-e defines a retail employer as one “employing at least ten retail employees”, counted statewide since Chapter 72 of 2025, signed 14 February 2025. The Department of Labor model workplace violence prevention policy – or an equivalent – is distributed at hire and annually thereafter, with training at hire, then annually where there are 50 or more retail employees and every two years below 50. From 1 January 2027, employers with 500 or more retail employees statewide must give every retail employee a silent response button – fixed, wearable or phone-based – with location tracking prohibited except when activated. Retail employs 69,904 in Nassau and 73,395 in Suffolk.
- Supervisors are named in the policy. The state model policy required by section 201-g must state that harassment is employee misconduct with sanctions against supervisors who knowingly allow it to continue, and must contain a standard complaint form and a timely and confidential investigation procedure. That sits over a discrimination standard that disclaims “severe or pervasive” and leaves a defence only for conduct amounting to no more than petty slights or trivial inconveniences, at employers of any size – and over two county codes, Suffolk’s and Nassau’s, that also have no headcount floor.
- And training-cost recovery ended in December 2025. The Trapped at Work Act, Labor Law Article 37 sections 1050 to 1055, effective 19 December 2025, declares employment promissory notes “unconscionable, against public policy, and unenforceable”, expressly reaching training-cost repayment framing. Carve-outs cover genuine cash advances that are not training, property sold or leased to the employee, educational sabbatical terms and collectively bargained programmes. In a market with this much skilled trade and manufacturing work, certification sponsorship terms need auditing now.

Nassau’s private sector employs 636,327 and Suffolk’s 690,153, across 56,359 and 56,286 establishments respectively, both at an average weekly wage of exactly $1,634 – 104.1 percent of the United States average of $1,569 (BLS Quarterly Census of Employment and Wages, Q4 2025, released 2 June 2026). Nassau averages 10.0 employees per establishment, which means annual training has to be delivered to a very large number of very small groups.
- And the two counties need different content. Suffolk carries manufacturing at 50,061 and construction at 46,897 – hazard-heavy, shift-based work – while Nassau’s mix is service-led with health care at 150,369 and a location quotient of 1.60, up 5.7 percent over the year. The same statutory obligation, two very different rooms.
