What California requires, and what the record has to show
- Training is mandatory from five employees. Government Code section 12950.1(h)(1) applies to “any person regularly employing five or more persons or regularly receiving the services of five or more persons providing services pursuant to a contract” – contractors count toward the threshold. Supervisory employees need at least two hours of classroom or other effective interactive training and non-supervisory employees at least one hour, once every two years, within six months of hire or of assuming a supervisory position. Seasonal and temporary employees hired for fewer than six months must be trained within 30 calendar days after hire or within 100 hours worked, whichever comes first; for temp-agency workers the temporary services employer trains, not the client.
- The content is specified, including two elements generic decks omit. Federal and state law on prohibition, prevention and correction of sexual harassment; remedies; practical examples; trainers with relevant expertise – plus prevention of abusive conduct under section 12950.1(a)(2) and harassment based on gender identity, gender expression and sexual orientation with practical examples under section 12950.1(a)(3). The Civil Rights Department publishes free one-hour and two-hour courses and employers using them are deemed compliant.
- And from 1 January 2026 the record is inspectable. SB 513 amended Labor Code section 1198.5(a) so personnel records subject to inspection expressly include education or training records. Where maintained, each must include the employee’s name, the training provider’s name, the duration and date of the training, the core competencies covered – including equipment or software skills – and any resulting certification or qualification, produced within 30 calendar days of a request. A completion tick in a learning system will not satisfy that on its face.
- Compliance still does not discharge the underlying duty. Section 12950.1(c) states expressly that compliance does not insulate an employer from harassment liability, and a claim that training did not reach a particular individual does not by itself create liability. What is being tested is Government Code section 12940(k) – taking “all reasonable steps necessary to prevent discrimination and harassment from occurring.” Note also that FEHA generally applies at five employees under section 12926(d) but harassment reaches one under section 12940(j)(4)(A), and that damages are uncapped under section 12965(d) with a three-year filing window under section 12960(e)(5).
- No City of Irvine or Orange County training mandate was identified, so the state requirement stands alone.

Across the Anaheim-Santa Ana-Irvine division, private education and health services grew 4.9% and leisure and hospitality 3.0% over the year to July 2026, while information fell 5.3% and government 5.2%. High-span, supervisor-heavy workforces are exactly where section 12940(k) is won or lost.
