The FMLA has its own rule at 29 C.F.R. 825.107, eight successor-in-interest factors assessed in totality, under which accrued eligibility service transfers with the employees.
- If it comes with a restructuring, notice does. Texas has no mini-WARN statute, so federal WARN governs: 60 calendar days at 100 or more employees, counted by single site of employment, with a plant closing at 50 or more at a site in any 30-day period and a mass layoff at 33% or more and at least 50, or 500 or more.
