What an Austin assessment actually has to cover
- Locally: two findings, and one of them is a negative. Austin City Code Title 5, Chapter 5-3 prohibits discrimination in employment and is enforced by the City’s Civil Rights Division, resting on the express authorisation at Texas Labor Code section 21.151. Everything else is preempted: Texas Labor Code section 1.005, added by HB 2127 effective 1 September 2023, makes void any local ordinance regulating employment leave, hiring practices, breaks, employment benefits or scheduling practices. Austin’s 2018 paid sick leave ordinance was enjoined before it took effect and held unconstitutional in Texas Association of Business v. City of Austin, 565 S.W.3d 425 (Tex. App.-Austin 2018), with review denied 5 June 2020. One live exception we will not resolve: Austin’s Fair Chance Hiring ordinance, City Code Chapter 4-15, is still described as enforced by the City while section 1.005(b) names hiring practices as preempted, and no court has ruled.
- Federally: the threshold ladder. Title VII (42 U.S.C. 2000e(b)) and the ADA (42 U.S.C. 12111(5)(A)) at 15 employees for 20 or more calendar weeks; the ADEA (29 U.S.C. 630(b)) at 20; COBRA at 20 in the prior calendar year, chargeable at up to 102% of plan cost; FMLA at 50 for 20 or more workweeks (29 C.F.R. 825.104(a)); ACA applicable large employer status at 50 full-time employees including full-time equivalents on a prior-year look-back; EEO-1 and WARN at 100. Related companies are generally combined under section 414 of the Internal Revenue Code (IRS, page reviewed 8 August 2026).
- And in other states, obligations that start at the first employee. Twenty-one jurisdictions require paid sick leave – 18 states including the District of Columbia, plus earned paid leave laws in Illinois, Maine and Nevada (Congressional Research Service Report R48921, 28 April 2026) – with accrual at one hour per 30 hours worked in most, one per 40 in Connecticut, Illinois, Maine and Washington, and one per 52 in Vermont. Sixteen states plus DC have pay transparency laws in force. Twenty-three states plus DC have enacted paid family and medical leave programmes, 14 plus DC as mandatory payroll-funded social insurance (Bipartisan Policy Center, 23 April 2026 – a policy organisation rather than a government source). In a mandatory-contribution state the obligation starts at registration, not at a claim.
