What governs executive conduct in Austin

  • One local ordinance, on express statutory authority. Austin City Code Title 5, Chapter 5-3 prohibits discrimination in employment and is enforced by the City’s Civil Rights Division, which accepts complaints against private employers. It survives Texas’s field preemption because Texas Labor Code section 21.151 expressly provides that a political subdivision may adopt and enforce an ordinance prohibiting a practice already unlawful under Chapter 21, another state law or federal law. Note the limit built into that text: it authorises local enforcement of existing prohibitions, not the creation of new ones. No court has applied section 21.151 against section 1.005, so this is the operative framework rather than settled law.
  • Everything else local is preempted. Texas Labor Code section 1.005, added by HB 2127 effective 1 September 2023, makes void any local ordinance regulating employment leave, hiring practices, breaks, employment benefits, scheduling practices or other terms of employment beyond state or federal law. On its own litigation: the Third Court of Appeals reversed the trial court on 18 July 2025 on standing grounds rather than the merits, rehearing was denied 15 April 2026, and a petition for review has been pending at the Supreme Court of Texas since 29 June 2026.
  • The federal layer is where executive conduct is actually tested. Title VII (42 U.S.C. 2000e(b)) and the ADA (42 U.S.C. 12111(5)(A)) apply at 15 employees for 20 or more calendar weeks; the ADEA (29 U.S.C. 630(b)) at 20, protecting employees aged 40 and over. Because those tests count weeks rather than current headcount, a company that spiked above a threshold for a quarter remains covered after settling back below it.
  • And if the executive’s decisions reach other states, so does that state’s law. New York’s Human Rights Law applies to all employers under Executive Law section 292(5) with a three-year filing deadline under section 297(5), and rejects the federal “severe or pervasive” standard in favour of an affirmative defence only where conduct amounts to no more than petty slights or trivial inconveniences. California’s FEHA applies at five employees generally under Government Code section 12926(d) but at one or more for harassment under section 12940(j)(4)(A), with a three-year filing window and no statutory cap on damages.

We are not attorneys, and coaching creates no legal privilege. Where a matter is likely to be litigated it should be commissioned through employment counsel from the outset rather than converted afterwards.
