What a small Long Island employer actually owes
- The sick leave tier turns on your tax return, then on headcount. Labor Law section 196-b gives an employer with four or fewer employees in a calendar year 40 hours unpaid where net income was $1 million or less in the prior tax year, and 40 hours paid where it exceeded that. From five to 99 employees it is 40 paid hours; at 100 or more, 56 paid hours. Accrual is not less than one hour per 30 hours worked from commencement, with exempt employees deemed to work 40 hours a week unless their normal week is less. Front-loading is permitted and may not later be reduced. Unused leave carries over, though use may be capped at the tier figure; minimum increments may not exceed four hours; and balances must be produced within three business days of an oral or written request. No payout on separation.
- New York City’s extra 32 hours do not apply here. The Earned Safe and Sick Time Act and its 32 hours of immediately-available unpaid protected time off, added on 22 February 2026, are municipal. Long Island employers work from section 196-b alone – same tiers, no 32-hour grant. That is one of the few places where being outside the city is simpler rather than merely different.
- Twenty hours of paid prenatal leave, with no size tier at all. Labor Law section 196-b(4-a), effective 1 January 2025, requires “twenty hours of paid prenatal personal leave during any fifty-two week calendar period” in addition to sick leave, covering examinations, procedures, monitoring, testing and discussions with a provider related to the pregnancy, taken in hourly increments at the greater of regular rate or applicable minimum wage, with no payout on separation. A three-person employer owes the full 20 hours.
- And Paid Family Leave costs you nothing but must be carried. Coverage is required of most private employers with one or more employees and is fully funded by employee payroll contributions – 0.432 percent of gross wages per pay period in 2026 to an annual maximum of $411.91, funding 12 weeks at 67 percent of average weekly wage, capped at 67 percent of the state average weekly wage of $1,833.63, giving a maximum weekly benefit of $1,228.53. Separately, Labor Law section 206-c requires 30 minutes of paid break time per lactation need for up to three years after childbirth, with a written policy distributed at hire, annually and on return to work and a response to requests within five business days.

Its private sector employs 636,327 at an average annual pay of $79,792, 101.4 percent of the national figure, with no sector above a location quotient of 1.60 – the most balanced mix in the region.
- Suffolk is larger and more industrial. 690,153 private employees at $81,103, with manufacturing at 50,061, construction at 46,897 across 7,399 establishments, and health care up 9.4 percent to 111,168. Both counties recorded an average weekly wage of exactly $1,634 in the fourth quarter of 2025 – 104.1 percent of the United States average of $1,569, and the only identical pair in the New York region (BLS Quarterly Census of Employment and Wages, Q4 2025, released 2 June 2026).
- Benefits are a recruiting argument in a tight market. Unemployment was 3.5 percent in Nassau and 3.6 percent in Suffolk in June 2026 – the lowest in the region, against 4.7 percent in Manhattan and 7.1 percent in the Bronx – having risen from 3.2 percent in each a year earlier. At the 2026 minimum wage of $17.00, 40 hours of sick leave plus 20 hours of prenatal leave is about $1,020 per employee per year, calculated from the published rate and hour figures.
