What Broward protects that Florida law does not
- The Broward County Human Rights Act reaches five employees. Broward County Code ch. 16.5 applies to employers with five or more employees for 20 or more weeks, and gives a complainant one year to file. Its protected characteristics include sexual orientation, gender identity and gender expression, marital status, political affiliation and pregnancy. The City of Fort Lauderdale has its own parallel chapter, Code ch. 29, adopted as Ord. c-19-30 on 17 September 2019, on the same five-employee, 20-week threshold. We do not state a filing deadline for the city chapter – we have not confirmed it from the code text, and the county figure should not be assumed to carry over.
- The state statute is narrower on both counts. The Florida Civil Rights Act, Fla. Stat. sections 760.01 to 760.11, does not apply until 15 employees for each working day in 20 or more calendar weeks (section 760.02(7)). Its enumerated characteristics are race, colour, religion, sex, pregnancy, national origin, age, handicap and marital status. Sexual orientation and gender identity are not in the FCRA text, and neither is political affiliation. A Broward employer with 8 employees is outside the FCRA and Title VII entirely and inside ch. 16.5 – and the conduct ch. 16.5 covers is broader. Neither local chapter is preempted: Fla. Stat. section 218.077 reaches only minimum wages and employment benefits.
- Florida requires no training at all, which raises rather than lowers the stakes. Nothing in the FCRA imposes a harassment, anti-discrimination or manager training duty on private employers, and neither Broward County nor Fort Lauderdale requires one. Meanwhile Fla. Stat. section 760.11 allows compensatory damages including mental anguish and loss of dignity with no statutory cap, punitive damages capped at $100,000, and attorney fees at the court’s discretion. Federal Title VII caps combined compensatory and punitive damages at $50,000 to $300,000 by employer size. Training here is not compliance theatre; it is the only control over the uncapped element.
- Political affiliation is the characteristic managers have never been trained on. It appears in almost no state employment statute and in no federal one. In a county code that also reaches five-person employers, it means supervisor conduct around political speech, campaign activity and off-duty association is a live exposure in Broward that simply does not exist for the same company’s Texas or Georgia sites.

- Training and development managers (SOC 11-3131) 940 employed across the MSA at a location quotient of 1.08, annual mean $132,430 against a national $148,370 – 10.7% below.
- The pattern is worth naming: the region pays a small premium for people who deliver training and a 10.7% discount for people who manage it. That is a market that buys programme design from outside and delivers in-house.
- Who needs the training. Broward’s largest private sector is retail at 105,815 employees, followed by health care at 96,707 and accommodation and food services at 83,788, plus an unusually large administrative and waste services base of 78,964 (BLS Quarterly Census of Employment and Wages, Q4 2025, released 2 June 2026). Those are high-headcount, high-turnover, heavily supervised workforces – exactly where a five-employee threshold and an uncapped damages regime meet frontline manager conduct.
