What a PEO actually shifts under Florida law, and what it does not

  • Workers compensation thresholds. Fla. Stat. section 440.02(20)(b)2 requires coverage for all private employment with four or more employees, and for all construction employment with one or more. Full-time and part-time employees both count, and the Florida Division of Workers Compensation states coverage applies whether the employee works at the employer’s physical location or remotely. Agriculture is six or more regular employees and twelve or more seasonal working 30 or more days. Contractors carry an extra duty under section 440.10(1)(g): verify that every subcontractor complies before the subcontractor starts work. In Broward, where construction employed 53,416 people in the fourth quarter of 2025, the one-employee construction threshold is the live one.
  • A leasing company is an employer for coverage – by statute. Fla. Stat. section 440.02(19)(a) treats employee leasing companies and employment agencies that supply their own employees as employers. That is the genuine transfer a PEO offers.
  • E-Verify is a contract question, not a statutory one. Fla. Stat. section 448.095(2)(f) provides that where a written agreement places the primary E-Verify obligation on the client company, the leasing company need not verify. So whether your PEO carries that duty depends on what your service agreement says, not on the fact that you use a PEO. Read it before assuming it has moved.
  • Broward’s wage theft ordinance follows the wages, and it has no threshold. Broward County Code ch. 20.5 (Ord. 2018-36, 13 September 2018) binds every private employer in the county: $60 minimum claim, payment presumed within 14 calendar days absent an established regular pay schedule, 60-day notice, 15-day cure, one-year filing, and damages of twice the unpaid wages plus costs and fees. Section 20.5-8 imposes a posting duty on employers with a Broward office. A co-employment arrangement does not make the ordinance somebody else’s problem by default.
  • Out-of-state coverage does not travel. An out-of-state employer working in Florida needs a Florida policy or a Florida 3.A. endorsement, and extraterritorial reciprocity runs only to 10 consecutive days or 25 total days in a calendar year.

Broward County employment fell 0.5% over the QCEW year to December 2025, and the Fort Lauderdale-Pompano Beach-Sunrise division lost jobs over the year to July 2026 – one of only two of Florida’s 25 metropolitan areas to do so (FloridaCommerce preliminary July 2026 figures, released 21 August 2026).
