The Florida obligations that arrive before you have an HR department

  • Ten persons: the Private Whistleblower Act. Fla. Stat. sections 448.101 to 448.105 apply to any private employer who employs ten or more persons. It protects an employee who discloses or threatens to disclose, to an appropriate governmental agency, an activity, policy or practice of the employer that violates a law, rule or regulation; who provides information to or testifies before an agency investigating the employer; or who objects to or refuses to participate in such an activity. The retaliation question routinely has a lower coverage threshold than the underlying complaint, and it is the claim that survives when the original one does not.
  • Two employees: equal pay. Fla. Stat. section 448.07 prohibits paying different wages to employees of different sexes for equal work in the same establishment, at any employer with two or more employees.
  • No threshold at all: Broward wage theft. Broward County Code ch. 20.5 (Ord. 2018-36, 13 September 2018) binds every private employer in the county with no headcount floor, opening at $60 in unpaid wages, presuming payment within 14 calendar days absent an established regular pay schedule, requiring pre-suit notice within 60 days and allowing the employer 15 days to cure, with a one-year filing deadline and damages of twice the unpaid wages.
  • Five employees: two local discrimination codes. Broward County Code ch. 16.5 and City of Fort Lauderdale Code ch. 29 (Ord. c-19-30, 17 September 2019) both start at five employees for 20 or more weeks, and both reach characteristics the Florida Civil Rights Act does not name. The FCRA itself does not apply until 15 (Fla. Stat. section 760.02(7)).

The pattern is that Florida’s genuinely low thresholds are the ones nobody markets to you: two for equal pay, ten for whistleblower, five for the local codes, none at all for wage theft in Broward. We are not attorneys, and a retaliation allegation in particular should go to Florida employment counsel early rather than be handled internally.

The capability Fort Lauderdale is scarcest in

BLS stopped publishing metropolitan division occupational wage estimates with the May 2018 release, so occupational figures are for the Miami-Fort Lauderdale-West Palm Beach MSA (area 33100), which contains Broward County, from the May 2025 estimates released 15 May 2026.

  • Labor relations specialists (SOC 13-1075) 630 across the entire MSA at a location quotient of 0.54 – barely half the national concentration and the second-lowest of any HR occupation in the region. Annual mean $89,970 against a national $98,720.
  • This is the occupation that handles grievances, internal complaints, investigations and retaliation exposure, and South Florida has close to half the national supply of it per job. Florida is a right-to-work state with low union density, so the bench was never built. The practical consequence for a 12-person Broward employer is that the capability the Private Whistleblower Act makes relevant at ten employees is not something you can go and hire at any price the business would recognize.
  • Human resources assistants (SOC 43-4161) sit even lower, at a location quotient of 0.51 with 830 employed across the MSA and an annual mean of $50,060 – the thinnest transactional HR layer of any large Florida metro.
  • The businesses needing this are small and numerous. Broward County held 82,085 establishments against 870,168 employees in the fourth quarter of 2025, more separate businesses than Hillsborough County’s 58,405 or Palm Beach County’s 71,508 (BLS Quarterly Census of Employment and Wages, Q4 2025, released 2 June 2026). Derived from those two figures, Broward averages roughly 10.6 employees per establishment.

How a subscription arrangement works from Melissa, Texas

Exceptional HR Solutions has one physical location, Melissa, Texas. There is no Fort Lauderdale office and no Broward staff. A subscription is a fixed monthly arrangement with a named practitioner, a defined response commitment and an agreed scope, delivered remotely. It suits an employer between roughly ten and a hundred people who has crossed several thresholds, has no internal HR, and needs advice to arrive the same day rather than after a procurement exercise. It is not a fractional HR leadership arrangement – a subscription answers what comes up, a fractional leader owns the plan.

Questions

Frequently asked questions

At what size does Florida’s whistleblower law apply?

Ten or more persons. Fla. Stat. sections 448.101 to 448.105 protect employees who disclose or object to an employer activity, policy or practice that violates a law, rule or regulation. That is five fewer than the Florida Civil Rights Act threshold of 15.

Which Fort Lauderdale obligation applies at any size at all?

The Broward County wage theft ordinance, Code ch. 20.5, adopted as Ordinance 2018-36 on 13 September 2018. It has no headcount threshold, opens at $60 in unpaid wages, and carries damages of twice the underpayment plus costs and fees.

What is the difference between subscription HR and fractional HR?

Scope of ownership. A subscription answers questions and handles matters as they arise, on a fixed monthly fee with a defined response commitment. A fractional HR leader owns the roadmap, sets priorities and carries decisions on a standing cadence. Employers typically move from the first to the second when the questions stop being one-offs.

Can we just hire someone to handle this in Broward?

At small scale it is genuinely difficult. The Miami-Fort Lauderdale-West Palm Beach MSA has 630 labor relations specialists at a location quotient of 0.54, roughly half the national concentration, and 830 HR assistants at 0.51. The capabilities that Broward’s thresholds make relevant are the ones the region is thinnest in.

Does a subscription include representing us in a wage claim?

No. We are not attorneys and do not represent clients before any agency or court. We help you assemble and check the response inside the cure windows – 15 days under Broward ch. 20.5 after a 60-day notice, and 15 days under Fla. Stat. section 448.110(6) – and tell you when counsel is needed.

How many businesses in Broward are this size?

Most of them. Broward held 82,085 establishments against 870,168 employees in the fourth quarter of 2025, which works out at roughly 10.6 employees per establishment as a derived average. It has more separate businesses than Hillsborough or Palm Beach counties.

Are you located in Fort Lauderdale?

No. Our only physical location is Melissa, Texas, and Fort Lauderdale subscription support is delivered remotely from there. We have no Broward County office, staff or partner network.
