The Broward wage theft ordinance, in full

Broward County Code ch. 20.5, sections 20.5-1 to 20.5-9, adopted as Ordinance 2018-36 on 13 September 2018, binds all private employers in the county – there is no headcount threshold. It is not preempted, because Fla. Stat. section 218.077 reaches only the setting of minimum wages and employment benefits, not the non-payment of wages already agreed.

  • Threshold and timing. A claim opens at $60 in unpaid wages. Absent an established regular pay schedule, wages are due within 14 calendar days of the work performed. The complainant must give pre-suit notice within 60 days, and the employer then has 15 days to cure. The filing deadline is one year.
  • The remedy is doubled. On a finding, the employer owes back wages plus liquidated damages equal to the unpaid wages – twice the underpayment – together with costs and attorney fees. A good-faith defence can reduce the award, which is the entire practical argument for having documentation ready inside the 15-day cure window rather than after it.
  • There is a posting duty. Section 20.5-8 requires employers with a Broward County office to post notice of the ordinance. This is a live, checkable obligation that most employers who moved into the county after 2018 have never actioned.
  • The state track runs alongside it. Fla. Stat. section 448.110(6)(a) and (b), since ch. 2023-222, separately require an aggrieved person to serve written notice identifying the wage claimed, the dates and hours worked and the total alleged unpaid wages, allowing 15 calendar days to cure before filing suit, with a four-year limitation period and five where willful.   • That is a county of small employers. Small employers are precisely the ones with no HR function, and the Broward wage theft ordinance has no headcount threshold – it binds a three-person business exactly as it binds a three-thousand-person one.
