What New York rules require of an HR system

  • Two buckets, two behaviours, one balance. Labor Law section 196-b accrues paid sick leave at not less than one hour per 30 hours worked to 40 hours at five to 99 employees or 56 at 100 or more; unused accrued time carries over, though use may be capped at the tier figure, and minimum increments may not exceed four hours. Since 22 February 2026, New York City Local Law 145 of 2025 adds 32 hours of immediately-available unpaid protected time off, granted on the first day of work and again on the first day of each calendar year – and those 32 hours do not carry over. A system holding a single leave balance cannot represent that, and 20 hours of paid prenatal personal leave under section 196-b(4-a) sits outside both, in hourly increments, at every employer size.
  • Three business days to produce the numbers. Section 196-b(11) requires that on oral or written request the employer supply the amounts of sick leave accrued and used within three business days. That is a reporting requirement with a deadline, which means the accrual has to be computed continuously rather than at year end – and it has to be explainable, because the employee is entitled to the figures rather than a balance.
  • Six years of payroll records, and thirteen wage statement fields. Labor Law section 195(4) requires records “established, maintained and preserved for not less than six years”. Section 195(3) fixes the statement contents, adding for non-exempt employees the regular hourly rate, the overtime rate, the regular hours worked and the overtime hours worked. Failures run at $250 per work day to a $5,000 cap under section 198(1-d). The hiring notice under section 195(1) must exist in English and the employee’s identified primary language with a signed acknowledgment kept the same six years – a document-retention problem, not a payroll one.
  • And any tool that screens or ranks candidates needs an audit trail of its own. New York City’s Local Law 144 of 2021, effective 1 January 2023 with enforcement from 5 July 2023, requires a bias audit within one year of use by an independent auditor with no employment by, financial interest in, or prior involvement with either employer or vendor, calculating selection or scoring rates and impact ratios across sex, race and ethnicity, and intersectional categories, with a summary published on the employer’s website. Candidates get 10 business days’ notice before the tool is used. Penalties are up to $500 for a first violation and $500 to $1,500 thereafter – but “each day on which an automated employment decision tool is used in violation… shall give rise to a separate violation.”
