The obligations that exist at one employee

  • The discrimination law has no floor. Executive Law section 292(5) defines employer as “all employers within the state” – the pre-2019 four-employee minimum was removed with effect from 8 February 2020. Protected characteristics under section 296(1)(a) include age, race, creed, colour, national origin, citizenship or immigration status, sexual orientation, gender identity or expression, military status, sex, disability, predisposing genetic characteristics, familial status, marital status, and status as a victim of domestic violence. The standard is lower than the federal one: section 296 disclaims “severe or pervasive” and leaves a defence only where the conduct amounts to no more than petty slights or trivial inconveniences. In New York City the human rights law generally starts at four persons – but for gender-based harassment it reaches employers of any size under Administrative Code section 8-102.
  • Harassment training is annual from the first hire. Labor Law section 201-g applies to every employer with no minimum headcount; state guidance is explicit that this includes a household employing one nanny or housekeeper. The employer must adopt the state model policy or one that equals or exceeds it, and deliver interactive training annually. The policy and training material go out in writing in English and in each employee’s identified primary language, at hire and at every annual training. The model policy was last updated August 2024.
  • Leave entitlements start at one, and one of them has no tier at all. Labor Law section 196-b(4-a), effective 1 January 2025, requires “twenty hours of paid prenatal personal leave during any fifty-two week calendar period” in addition to sick leave, with no employer size tier – a three-person employer owes the full 20 hours, in hourly increments, at the greater of the regular rate or the applicable minimum wage. Paid Family Leave covers most private employers with one or more employees and is fully funded by employee contributions – 0.432 percent of gross wages in 2026, capped at $411.91 a year, for 12 weeks at 67 percent of average weekly wage up to $1,228.53. Sick leave itself is tiered, at 40 paid hours from five employees and 56 at 100.
  • And the documentary duties are identical at four employees and four hundred. The hiring notice under Labor Law section 195(1) must be in English and the employee’s primary language, with a signed acknowledgment kept six years; wage statements must carry the full section 195(3) field list, including four extra items for non-exempt employees; and payroll records are preserved for not less than six years. A written lactation accommodation policy under section 206-c goes out at hire, annually, and on return to work, with a response to requests within five business days.
