What day one has to produce in Brooklyn
- The hiring notice, in two languages, signed, kept six years. Labor Law section 195(1) requires a written notice at time of hire in English and in the employee’s identified primary language, stating the rate or rates of pay and the basis, any allowances claimed as part of the minimum wage – tip, meal or lodging – the regular payday, and the employer’s name, any trading name, physical address and telephone. The employer must obtain a signed and dated acknowledgment of receipt in both languages and preserve it for six years. Failure carries $50 for each work day the violation continues, capped at $5,000, under section 198(1-b).
- The harassment policy, also in the employee’s primary language. Labor Law section 201-g requires every employer with no size minimum to give the prevention policy and the training material in writing at time of hiring and at every annual training, in English and in each employee’s identified primary language. The policy must meet or exceed the state model – last updated August 2024 – including examples of prohibited conduct, remedies, a standard complaint form, a confidential investigation procedure, sanctions against supervisors who knowingly allow harassment, and an anti-retaliation statement. In New York City, employers with 15 or more employees or one or more domestic workers must additionally give the Commission factsheet to every new employee within the first week, post the notice in English and Spanish, and train new hires after 90 days where they will work more than 80 hours in a calendar year.
