What a Brooklyn payroll has to produce
- Nine items on every statement, four more for non-exempt employees. Labor Law section 195(3) requires the dates of work covered, the employee’s name, the employer’s name, address and telephone, the rate or rates and basis of pay, gross wages, deductions, allowances claimed, and net wages – plus, for non-exempt employees, the regular hourly rate, the overtime rate, the number of regular hours worked and the number of overtime hours worked. Home care aide benefits and prevailing wage supplements appear where applicable. Section 198(1-d) prices a failure at “two hundred fifty dollars for each work day that the violations occurred or continue to occur”, capped at $5,000 per employee, plus attorney’s fees and costs.
- Six years of records, not three. Section 195(4) requires employers to “establish, maintain and preserve for not less than six years contemporaneous, true, and accurate payroll records.” The hiring notice acknowledgment under section 195(1) – signed, dated, in English and the employee’s identified primary language – is preserved for the same six years, with failures at $50 per work day to a $5,000 cap under section 198(1-b).
- Two rate structures and two tip credits. From 1 January 2026, the minimum wage is $17.00 in New York City, Nassau, Suffolk and Westchester and $16.00 in the remainder of the state. Service employees in the higher region run at $14.15 cash plus a $2.85 tip credit; food service workers at $11.35 plus $5.65. In the rest of the state those figures are $13.30 plus $2.70 and $10.70 plus $5.30. The executive and administrative exempt salary threshold is $1,275.00 per week in the higher region and $1,199.10 elsewhere – and New York sets no state threshold for the professional exemption, where the federal rule applies. From 2027 the minimum wage is indexed to a three-year average of the Northeast Consumer Price Index; no 2027 dollar figure has been published.
- And two deductions run through the same payroll. New York Paid Family Leave is fully funded by employee payroll contributions: 0.432 percent of gross wages per pay period in 2026, to an annual maximum of $411.91, funding 12 weeks at 67 percent of the employee’s average weekly wage, capped at 67 percent of the state average weekly wage of $1,833.63 – a maximum weekly benefit of $1,228.53. Coverage is required of most private employers with one or more employees, and the rate and cap change each January, so it is a payroll configuration item rather than a benefits renewal item. Separately, allowances claimed as part of the minimum wage – tip, meal and lodging – must appear both on the section 195(1) hiring notice and on every wage statement under section 195(3), which means the allowance decision has to be recorded in the payroll system rather than held as a policy.
