What the Los Angeles hiring sequence has to look like

  • Ten employees in the City, and the job posting itself is regulated. The Fair Chance Initiative for Hiring Ordinance, LAMC Chapter XVIII Article 9, has applied since 22 January 2017 to employers with ten or more employees in the City of Los Angeles. Before any conditional offer there can be no inquiry into criminal history by any means – and job postings and solicitations must state that qualified applicants with criminal histories will be considered. That second requirement is the one most often missed, because it lands on the advertisement rather than on the interview.
  • The assessment must be written, and so must the reassessment. A conditional offer may be conditioned only on an assessment of criminal history against the duties and responsibilities of the position. The employer then performs a written individualized assessment applying the EEOC factors – the nature and gravity of the harm caused, the time that has passed, and the job’s duties, essential functions, circumstances and environment. Arrests not leading to conviction cannot be considered at all. If the assessment links the history to job risks, the Fair Chance Process requires written notice of the proposed adverse action with the assessment and supporting documentation attached, the job held open at least five business days, and the applicant allowed to submit documentation in that window – followed by a genuine reassessment, notification of the final decision, and if adverse, written notice with a copy of the reassessment. All related records are kept three years, and the required notice must be posted; the City publishes it in eight languages.
  • The County ordinance is different and reaches further. Los Angeles County’s Fair Chance Ordinance for Employers, County Code section 8.300, adopted 27 February 2024 and effective 3 September 2024, applies at five or more employees regardless of location, where the employer seeks to hire or employs people performing at least two hours of work on average each week in the unincorporated areas of the county. Its scope is not limited to hiring: DCBA states the process is required when adverse actions are taken on review of criminal history, including promotions, reassignment, discipline and termination. DCBA names five failures that expose an employer to administrative fines: inquiring during the interview before a conditional offer, failing to provide a Notice of Intent, never contacting the applicant after reviewing their history, considering arrests or other non-convictions, and failing to make a connection between the job duties and the convictions.
  • Salary history is separately off-limits statewide. Labor Code section 432.3(b) bars seeking salary history “orally or in writing, personally or through an agent”; section 432.3(a) bars relying on it; and section 432.3(k) provides prior salary can never justify a pay disparity. Asking about salary expectations is permitted, section 432.3(j). Employers with 15 or more employees must include the pay scale in any job posting, section 432.3(c)(3) – and from 1 January 2026 SB 642 redefines a pay scale as a “good faith estimate” of what the employer “reasonably expects to pay for the position upon hire.”

  • Unemployment at 5.2 percent, on a labour force of 4,937,400. Los Angeles County’s rate was 5.2 percent in July 2026, preliminary, with 257,700 people unemployed. On a like-for-like basis it has edged down, from 5.4 percent in May 2025 to 5.2 percent in May 2026 (BLS Local Area Unemployment Statistics). For context, in June 2026 the county’s 5.3 percent compared with California at 5.2 percent and the United States at 4.4 percent – this is a looser candidate market than the national one.
  • Where the candidates are coming from. Private information employment fell by 12,643 jobs, down 6.9 percent over the year, and motion picture and video production, NAICS 512110, fell 7,890 jobs, down 9.1 percent, to 78,795 in December 2025 across 6,423 establishments – at a location quotient of 13.72, roughly 13.7 times the national concentration (BLS Quarterly Census of Employment and Wages, Q4 2025, released 2 June 2026). Meanwhile health care and social assistance added 42,730 jobs, up 5.1 percent, and professional, scientific and technical services added 19,822, up 6.4 percent. Experienced production and post-production people are available; the sectors hiring are not the sectors releasing.
  • Recruiting capacity itself. The Los Angeles-Long Beach-Anaheim MSA employs 36,850 human resources specialists – the occupation that carries most recruiting – at a location quotient of exactly 1.00 and an annual mean of $89,780 against a national mean of $81,990 (BLS Occupational Employment and Wage Statistics, May 2025 estimates, released 15 May 2026).
