Where a Los Angeles manager’s discretion is limited by law
- Scheduling decisions are documented decisions. Under the City’s Fair Work Week Ordinance, LAMC Chapter XVIII Article 5 section 185, retail employers with 300 or more employees globally must let employees state scheduling preferences – the manager may accept or decline, but declines must be given in writing. Schedules run on 14 calendar days’ advance notice; a change inside that window needs written notice and the employee may decline certain changes, with any voluntary consent in writing. Additional hours must be offered to current qualified employees with 72 hours’ written notice before anyone new is hired. A closing shift followed by an opening shift needs written consent, and if the second starts less than 10 hours after the first ended, the following shift is paid at time and a half. Records are kept three years. Effective 1 April 2023, fully enforceable since 28 September 2023; the County runs a parallel retail ordinance for unincorporated areas from 1 July 2025.
- Changing a shift has a price list. Predictability pay under the City ordinance: an employer-initiated increase in hours beyond 15 minutes costs one hour at the regular rate; a change to the date, time or location costs one hour for each change; a reduction of at least 15 minutes costs the hours not worked at half the regular rate; and an on-call shift not called in costs the hours not worked at half rate. Managers who improvise around a rota are spending money without knowing it.
- Meetings about political or religious matters cannot be mandatory. Labor Code section 1137, the California Worker Freedom from Employer Intimidation Act, effective 1 January 2025, bars discharging, discriminating against, retaliating against or taking any other adverse action against an employee because they decline to attend an employer-sponsored meeting, or decline to receive or listen to communications, whose purpose is to communicate the employer’s opinion about religious or political matters. Employees who are working at the time and elect not to attend must continue to be paid while the meeting proceeds. “Political matters” is defined broadly at section 1137(b)(3) to include the decision to join or support any political party or political or labor organization. This provision has been the subject of litigation; check its current status with counsel before relying on any particular reading.
- And criminal-history decisions are made twice, in writing, by the manager. Los Angeles County’s Fair Chance Ordinance, County Code section 8.300, effective 3 September 2024 at five or more employees, requires the fair chance process for adverse actions based on review of criminal history – DCBA states that may include promotions, reassignment, discipline and termination, not only hiring. DCBA names failing to make a connection between the job duties and the convictions as conduct exposing an employer to administrative fines. That is a reasoning failure, and reasoning is a coachable skill.

- Restructuring is concentrated, not general. Between 1 July and 24 August 2026 Los Angeles County saw 22 WARN notices covering 1,063 employees, out of 154 notices and 7,770 employees statewide (California EDD WARN Report, extract of 24 August 2026 – a rolling eight-week window, not an annual total). Entertainment and media accounted for 223 of those employees, about 21 percent, across NBCUniversal, Netflix and Universal City Studios Productions; manufacturing for 317, about 30 percent. Managers in those sectors are leading through contraction while their colleagues in health care lead through 5.1 percent employment growth. The same coaching does not fit both.
