The leave stack a Brooklyn employer administers
- Fifty-six hours at 100 employees, forty below it. Labor Law section 196-b gives 56 paid hours per calendar year at 100 or more employees and 40 paid hours from five to 99. Employers with four or fewer owe 40 unpaid hours, or 40 paid if net income exceeded $1 million in the prior tax year. Accrual is not less than one hour per 30 hours worked from commencement of employment; front-loading is allowed but may not later be reduced or revoked based on hours actually worked. Unused leave carries over, though use may be capped at the tier figure. Minimum increments may be set but not above four hours – which for a workforce running short shifts is the operative constraint. No payout on separation, and the employee must be restored to the same position, pay and terms.
- New York City adds a second bucket that behaves differently. Since 22 February 2026, under Local Law 145 of 2025, every city employee also receives 32 hours of immediately-available unpaid protected time off, granted on the first day of work and again on the first day of each calendar year. The accrued 40 or 56 paid hours carry over; the 32 do not – they reset annually. Covered reasons now include care for a minor child or care recipient, attending legal proceedings on subsistence benefits or housing, responding to a public disaster, and responding to workplace violence. Any union carve-out must now provide a comparable benefit covering the 40 or 56 paid hours, the additional 32, the 20 hours of prenatal leave, and no discipline for use.
- Twenty hours of paid prenatal leave sits on top of both, at every size. Labor Law section 196-b(4-a), effective 1 January 2025, requires it “in addition to” sick leave, covering examinations, procedures, monitoring, testing and discussions with a provider related to the pregnancy, taken in hourly increments at the greater of regular rate or applicable minimum wage, with no payout on separation. New York City requires it in addition to protected time off under a rule effective 2 July 2025.
- And two entitlements are funded or paid differently again. Paid Family Leave is fully funded by employee contributions – 0.432 percent of gross wages in 2026 to a $411.91 annual maximum, giving 12 weeks at 67 percent of average weekly wage up to $1,228.53, with most private employers of one or more employees required to carry coverage. Labor Law section 206-c requires 30 minutes of paid break time per expression need for up to three years after childbirth, plus a written policy at hire, annually and on return to work, with a response to requests within five business days, and a space that is near the work area, well-lit, shielded, free from intrusion, with a chair, work surface, clean running water nearby and an outlet where available – never a restroom.
