What a Manhattan payroll has to get right
- Thirteen items on a non-exempt wage statement. Labor Law section 195(3) requires the dates of work covered, the employee’s name, the employer’s name, address and telephone, the rate or rates and basis of pay, gross wages, deductions, allowances claimed, and net wages – plus, for non-exempt employees, the regular hourly rate, the overtime rate, the number of regular hours worked and the number of overtime hours worked. Section 198(1-d) prices a failure at $250 for each work day the violation occurs or continues, capped at $5,000 per employee, plus attorney’s fees and costs. In an office population where most people are salaried, the exposure sits with the minority who are not – and those are usually the records nobody checks.
- The exempt threshold is low relative to this market, and it only covers two exemptions. From 1 January 2026 the executive and administrative exempt salary threshold is $1,275.00 per week – $66,300 a year – for New York City, Nassau, Suffolk and Westchester. New York sets no state salary threshold for the professional exemption, where the federal rule governs. Failure runs at $50 per work day to a $5,000 cap under section 198(1-b). A finance or professional-services employer hiring across a dozen first languages carries that duty at every desk.
- And one deduction is mandatory and repriced every January. New York Paid Family Leave is fully funded by employee payroll contributions at 0.432 percent of gross wages per pay period in 2026, to an annual maximum of $411.91, funding 12 weeks at 67 percent of average weekly wage capped at $1,228.53. Coverage is required of most private employers with one or more employees, and the employer pays no premium. Because the cap is a flat annual figure, in a high-wage population it is reached early in the year, which makes the stop logic a real configuration item rather than a rounding one.
