What the statutory benefits actually require here
- Paid Family Leave is employee-funded, capped, and repriced every January. The 2026 employee contribution is 0.432 percent of gross wages per pay period to an annual maximum of $411.91, funding 12 weeks at 67 percent of the employee’s average weekly wage, capped at 67 percent of the state average weekly wage of $1,833.63 – a maximum weekly benefit of $1,228.53. Most private employers with one or more employees must obtain coverage, and the employer bears no premium cost. In a high-earning population the annual cap is reached early in the year, and the benefit replaces a small fraction of pay – which is exactly why supplemental arrangements sit on top of it here and rarely elsewhere.
- Sick leave is hours, not salary, and the city adds a second bucket. Labor Law section 196-b gives 56 paid hours at 100 or more employees and 40 from five to 99, accruing at not less than one hour per 30 hours worked – with exempt employees deemed to work 40 hours a week unless their normal workweek is less. Unused leave carries over, use may be capped at the tier figure, and minimum increments may not exceed four hours. Since 22 February 2026, under New York City Local Law 145 of 2025, every city employee also receives 32 hours of immediately-available unpaid protected time off, granted on the first day of work and each calendar year, which do not carry over. Balances must be produced within three business days of an oral or written request.
- Twenty hours of paid prenatal leave, at every size, in hourly increments. Labor Law section 196-b(4-a), effective 1 January 2025, requires it “in addition to” sick leave, covering physical examinations, medical procedures, monitoring and testing, and discussions with a health care provider related to the pregnancy, paid at the greater of the regular rate or the applicable minimum wage, with no payout on separation and no employer size tier. New York City requires it in addition to protected time off under a rule effective 2 July 2025.
- And lactation accommodation is paid time with a specified room. Labor Law section 206-c requires 30 minutes of paid break time each time an employee has reasonable need to express milk, for up to three years following childbirth, with additional time available from existing paid break or meal periods. The space must be close to the work area, well-lit, shielded from view, free from intrusion, with a chair, a work surface, nearby clean running water and an electrical outlet where available – and it may not be a restroom. The written policy goes out at hire, annually, and on return to work, and must require a response to requests within five business days. In a tower with hot-desking and shared floors, the room is the hard part.
