What does not transfer to a co-employer
- The records duty runs to you, for six years. Labor Law section 195(4) requires employers to “establish, maintain and preserve for not less than six years contemporaneous, true, and accurate payroll records.” The section 195(1) hiring notice – in English and the employee’s identified primary language, signed and dated – is preserved for the same six years, and New York City training records under Local Law 96 for at least three years with a signed acknowledgment. Demands arrive years after arrangements end; the statutory duty does not follow the vendor.
- The decisions the city regulates are decisions, not transactions. The New York City Fair Chance Act applies at four or more employees, covers interns, freelancers and independent contractors, and requires a written analysis against the Fair Chance Factors, copies of all background documents relied on, and the job held open at least five business days. Local Law 32 of 2022 requires a good faith minimum and maximum in every advertisement including internal postings, at the same threshold, with uncured or subsequent violations reaching $250,000. Local Law 144 of 2021 requires an independent bias audit of any automated hiring or promotion tool, published on your website, with 10 business days’ notice to candidates – and no PEO can be the independent auditor either.
- Coverage and training obligations attach at one employee. Paid Family Leave requires most private employers with one or more employees to obtain insurance, funded entirely by employee contributions at 0.432 percent of gross wages in 2026 to a $411.91 annual cap, giving 12 weeks at 67 percent of average weekly wage up to $1,228.53. Labor Law section 201-g requires an annual interactive training and written policy for every employer, in each employee’s primary language. Executive Law section 292(5) covers “all employers within the state”, and New York City reaches any size for gender-based harassment.
- And the standard offer letter changed in December 2025. The Trapped at Work Act, Labor Law Article 37 sections 1050 to 1055, effective 19 December 2025, declares employment promissory notes “unconscionable, against public policy, and unenforceable” – ending training-cost and sign-on repayment clauses, with carve-outs for genuine cash advances, property sold or leased to the employee, educational sabbatical terms and collectively bargained programmes. Chapter 681 of 2025 separately banned the use of consumer credit history in hiring, promotion and terms of employment, effective 120 days after signing, with narrow exemptions including signatory financial authority over $10,000.
