Florida mandates no training, and that changes the calculation

  • There is no state training requirement for private employers. Nothing in the Florida Civil Rights Act, Fla. Stat. sections 760.01 to 760.11, imposes a harassment, anti-discrimination or manager training duty, and neither the City of Tampa nor Hillsborough County requires one. This is not a small difference. An employer with staff in New York faces Labor Law section 201-g, which mandates annual sexual harassment prevention training for every employer with no headcount minimum at all, and New York City Local Law 96 adds its own requirement at 15 employees. The same employer’s Tampa staff are covered by nothing.
  • The exposure that training controls is larger in Florida than under federal law. Fla. Stat. section 760.11 allows compensatory damages including mental anguish and loss of dignity with no statutory cap, punitive damages capped at $100,000, attorney fees at the court’s discretion, and preserves the right to a jury trial. Federal Title VII caps combined compensatory and punitive damages at between $50,000 and $300,000 depending on employer size. In Florida the uncapped element is the one that moves, and manager conduct is what drives it.
  • Local codes impose duties that training is how you actually meet. Hillsborough County Code ch. 30 and City of Tampa Code ch. 12 both carry an express reasonable accommodation duty, and the county chapter separately prohibits discriminatory information gathering. Neither is satisfied by a policy document. They are satisfied or missed by what a supervisor says in a conversation about a medical restriction or a pregnancy, which is a training problem.
  • Florida’s only break law covers minors, and supervisors get it wrong. Fla. Stat. section 450.081(4) requires a 30-minute meal interval for minors aged 15 and under after four continuous hours of work, and the same for 16 and 17 year olds working eight or more hours in a day. There is no adult meal or rest break requirement in Florida of any kind. Supervisors moving from a state that has one routinely apply the wrong rule in both directions.
