What Florida requires in a Tampa employee’s first week

  • E-Verify at 25 or more employees, within three business days. Fla. Stat. section 448.095(2)(b)2, added by ch. 2023-40 (SB 1718), has required private employers with 25 or more employees to verify each new hire through E-Verify since 1 July 2023. The check must be completed within three business days of the first day the employee works for pay, with documentation retained for three years, and compliance certified on the first reemployment assistance return of each calendar year. Since 1 July 2024 the penalty structure at section 448.095(6) gives FloridaCommerce a duty to notify and the employer 30 days to cure; three failures inside any 24-month period trigger $1,000 per day until cured plus grounds to suspend every state licence the business holds. The 25-employee line did not move this year: HB 197 would have extended E-Verify to all private employers from 1 July 2026, passed the Florida House 80-30 on 15 January 2026 and died in Senate Rules on 13 March 2026.
  • Independent contractors are outside it. Section 448.095 defines an employee as an individual filling a permanent position under the employer’s control, which excludes bona fide independent contractors, and also excludes casual labour performed entirely within a private residence. If E-Verify itself is unavailable for three business days, the statute directs the employer to use Form I-9 and document the outage, which in practice means a dated screenshot for each day.
  • Direct deposit is opt-in, and it is opt-in in writing. Fla. Stat. section 532.04 requires the employee’s written authorisation and a written designation of the receiving institution, and it bars terminating an employee solely for refusing direct deposit. Section 532.01 separately requires that any instrument issued in payment of wages, including a payroll debit card, be negotiable and payable in cash on demand without discount at a named Florida place of business, with sufficient funds for at least 30 days.
  • State the pay schedule in the onboarding pack. Hillsborough County Code ch. 51 (Ord. 15-25, adopted 21 October 2015) presumes wages are due within 14 calendar days of the work performed unless the employer has established, by policy or practice, a consistently applied recurring pay schedule. The onboarding packet is where that policy is evidenced. The Hillsborough ordinance is also unusually broad in reach: it covers independent contractors expressly, and employees working remotely from outside the county whose work benefits an employer located within it. Separately, Fla. Stat. section 448.109 requires a conspicuous minimum wage poster in English, Spanish and Creole at each establishment, and that poster changes on 30 September 2026 when the rate moves from $14.00 to $15.00.
